Myron To Join The Club?

By Greg L | 6 January 2007 | Blogs | 9 Comments

I notice that while in the midst of an upgrade Myron of Republitarian reports that he’s been threatened with what appears to be a defamation lawsuit. Myron writes:

Apparently, an attempt has been made to scare me with legal action with rumors circulating that I will be sued for something I have said on my blog.

First, let me say that I would have no idea why a suit against me would be sought in the first place and second, if this person wants to sue…bring it. I know how to defend myself. Won’t cost me a dime.

I pulled my website for an upgrade and focus change…long before this silly little threat of a lawsuit.

I don’t follow Republitarian too closely, but I’ve enjoyed a number of Myron’s posts. From what I’ve seen on his blog, the assertion that anything he has written is potentially actionable seems utterly stupid. He’s not that kind of blogger.

But until we get a few things sorted out in the courts regarding blogs and their legal liability, it doesn’t surprise me that these threats continue to pop up from time to time. We need a clear precedent in Virginia which will absolutely clarify what does and does not constitute defamation of public figures not only to help bloggers, but to put an end to these somewhat frequent threats. I continue to feel that my case with Steve Chapman is a great case to establish this precedent in a way that will allow political bloggers their rightful degree of latitude.

In my case with Mr. Chapman, I’ve answered interrogatories and there’s been one mention by the plaintiff of a possible settlement which hasn’t gone anywhere in months. There’s been silence ever since that may have something to do with the ‘07 election for 51st District in the House of Delegates. I’d rather this moved forward so I could finally rid myself of this minor annoyance, but I’m not so naive as to believe that the administration of justice is always as swift as it’s supposed to be.

Myron should feel free to borrow a notorious riposte from BVBL history should he feel confident enough to want to torque a plaintiff and his attorneys a bit. It’ll definitely generate some media interest, but I wouldn’t want to use that with an attorney of sufficient skill and experience that he can correctly spell the word ‘counselor’.

I’ve heard such rumored threats in regard to myself as well. What a bunch of BS.

I’m not sure what you’re insinuating, but “counsellor” (2 L’s) is by definition a licensed attorney. Or did he spell it “councillor” or something like that?

While I’m not really concerned with being sued, I would be interested where that threat originated.

I know it has something to do with KATEY O G’s divorce….

Were YOU the source of the email forwarded to NLS, Myron? You know the one…which raised all the controversy before Christmas? If you were, you’re in WAY more over your head than Greg ever was, especially if you edited it, or were the original source.

I agree that I’ve not seen anything posted on Myron’s blog which is facially actionable. On the other hand, I (and probably others) repeatedly warned you, Greg.

As far as we know there is no law suit and it is nothing more than a poorly planted rumor. The origin and intent of the rumored suit are the only points of interest in this story.

    AWCheney,
    NO!

    AW,

    Trust me….

Good ‘ole farmboys don’t get sent e-mails like that. I read the e-mail posted by Ben like everyone else. Innocent as the wind driven snow….as usual.
