Northern Virginia Hall Of Shame

While Joe over at NovaTownHall gives the smackdown to Senator Stolle for his support for illegal aliens in the Virginia Senate, there are a few other Delegates and Senators who deserve mention for actively working to continue the endangerment of our citizens by illegal aliens. Northern Virginia has it’s hall of shame as well, and it’s a lot more extensive than the one for Hampton Roads.
This year the House passed a bill HB 3130 (BPOL tax; refusal to grant and revocation of business licenses) that would have prohibited the issuance of a business license to any individual who cannot provide legal documents proving such individual is legally eligible to be employed or to work in the United States. The bill also authorizes commissioners of the revenue to revoke a license that has already been issued to such an individual.
Here is the vote for and against that bill in the House.

Northern Virginia delegates who voted “NO”, include Delegate Bob Hull who switched his vote, and Amundson, Brink, Caputo, Ebbin, Eisenberg, Englin, Moran, Plum, Poisson, Shannon, Sickles, and Watts. John Chichester, who has thankfully retired, refused to give the bill a hearing in the Senate Finance Committee. The ranking Minority member on that committee is Senator Chuck Colgan, and neither he nor Chichester chose to use their influence to insist that this good bill, which passed in the House with a wide majority, got a hearing.
The House also passed HB 2622 (Illegal alien; person who conceals or shields guilty of felony) that would have provided that any person who as a part of a commercial enterprise harbors, transports, or conceals an alien is guilty of a Class 6 felony if he knew that the alien was in the United States illegally. Toddy Puller and another Northern Virginia Democrat, Janet Howell, voted to kill this bill.
The House passed HB 2687 (Unfair employment practices; discharging employees when unauthorized aliens are employed) that states that it is an unfair employment practice for an employer to knowingly employ any unauthorized alien within the Commonwealth. An employee who is replaced by his employer with an unauthorized alien shall have a cause of action against his employer on or after July 1, 2007. Employers that are enrolled and participate in the federal Basic Pilot Program, which helps identify document fraud by illegal aliens, are exempt from compliance with federal employment verification procedures under federal law, or have obtained certain employment eligibility verification documentation, and are not subject to this measure. Someone discharged in violation of this unfair employment practice is entitled to recover treble damages, including lost wages from the date of the discharge until the date the employee has procured new employment, or 120 days, whichever occurs earlier, and reasonable attorney’s fees and costs.

The Northern Virginia Democrats who couldn’t even muster enough guts to give a legal citizen the right to sue if they lose their job to an illegal alien are as follows: Amundson, Brink, Caputo, Ebbin, Eisenberg, Englin, Howell, Marsden, Moran, Plum, Poisson, Scott, J.M., Shannon, Sickles, and Watts.
The clear problem here is that some Northern Virginia Democrats and the Governor are going out of their way to protect illegal aliens. It’s not just Senator Stolle in Virginia Beach who is responsible for obstructing efforts to control illegal aliens, it’s a large portion of the Democratic Caucus from Northern Virginia. In order to adequately address the problem of illegal aliens in Virginia, this Northern Virginia Democratic Hall of Shame needs to be voted out of office:

As I mentioned in another post. Many of these people are open supporters of illegals, and nothing will change that. As it is unlikely to get anti-illegals elected in Arlington and Alexandria, the focus should be on areas that are open to candidates that are opposed to illegals. That way if enough of the anti-illegals are elected, and I would figure most would be Republicans, things can change.
If the Republicans gain a larger share of the Senate is it possible to reshape committes from those that support illegals to those that do not support illegals? That would ensure many of these bills would make it out of Committee, and have a much better chance to pass both the Senate. The house needs some work but not as much as the Senate.

You are missing a very important bill sponsored by Del. Tom Rust and championed by AG Bob that cleared the House by an overwhelming majority 92-6.
HB2926 Immigration; powers of law-enforcement officers. Expands the powers of state and local law-enforcement officials to include immigration powers conferred upon the law-enforcement agency by agreement with the U.S. Department of Homeland Security. The bill also allows the Department of Corrections to receive any person into a state facility committed under the authority of the United States.

First, I want to extend my personal sympathy to the Tranchant and Kunhardt families for the devastating tragedy that has and will continue to affect them. They remain in our thoughts and prayers.
I find it ironic that, had the intoxicated driver been born and raised in Virginia Beach, little notice would have been given to this senseless tragedy by either the media or the community at large.

It is important to recognize that the Code of Virginia, under Section 19.2-81.6, only gives local and state police the authority to charge someone as an illegal alien after they have been:
- Previously convicted of a felony and
- Previously deported or left the United States after such conviction and
- Have reentered the United States and
- Have been arrested again.
- Even under those circumstances, we’re only authorized to hold them for 72 hours.
I’m sure you are aware of the divergent opinions regarding local law enforcement’s involvement, or lack thereof, in enforcing Federal immigration laws. Too many are trying to make Federal immigration issues a local police problem.
Following is an excerpt from our Department’s policy regarding the enforcement of Immigration laws:
Policy
The enforcement of the nation’s immigration laws is primarily the responsibility of the federal government. Accordingly, the Virginia Beach Police Department shall not undertake immigration-related investigations and shall not routinely inquire into the immigration status of persons encountered during police operations.
This prohibition does not preclude the Department from cooperating with federal immigration officials when requested, or from notifying those officials in serious situations where a potential threat to the public is perceived.
Inquiries into Immigration Status
A person’s right to file a police report, participate in police-community activities, or otherwise benefit from police services is not contingent upon citizenship or immigration status. Consequently, officers shall not question any person about his or her citizenship or immigration status or inform federal immigration authorities of the whereabouts or behavior of any immigrant or foreign visitor, unless that person:
1. Is arrested for any felony
2. Has been convicted of any felony, regardless of whether that felony involved violence
3. Is arrested for a terrorism-related offense, or is otherwise reasonably suspected of involvement in terrorism and/or subversive activities
4. Is arrested for any offense involving the entry or fraudulent assimilation of undocumented foreigners into the country, or is reasonably suspected of participating in an organized venture to bring or fraudulently assimilate undocumented foreigners into the country
5. Is reasonably suspected of participating in criminal street gang activity
Officers shall not request passports, visas, “green cards,” or travel documents in lieu of, or in addition to, driver’s licenses and similar standard forms of identification. Such documents shall only be requested
when standard forms of identification are unavailable, or when the officer is proceeding under the conditions described above.
This stance was crafted internally by the Police Department in July of 2004 and the formal policy was adopted by our Command Staff in September of 2005. Neither the Mayor nor anyone else on City Council had any input into this policy. The bottom line is, that as Chief of Police, it is my policy. It is also similar to polices of many other major city police departments.
The nearly universal opinion of the chiefs I’ve spoken to about this is consistent with mine, and that is that not only do we not have the capacity to do the Federal government’s work in the area of immigration, we have no business doing so. This position is based upon several things, including 1) immigration violations are civil rather than criminal violations; 2) Immigrations and Customs Enforcement (ICE) is both understaffed and under-funded, and typically does not respond to calls from local police who have undocumented aliens in custody unless the charges are major felonies or otherwise high profile. In fact, ICE has told us there is nothing they can do unless the individual is arrested for a felony. In the case of Mr. Ramos, we did notify ICE and they have issued a detainer for him; 3) there are a reported 12 million undocumented immigrants currently in the U.S. and another estimated 800,000 entering the country annually. As long as the nation’s borders continue to be unsecured, the number of individuals illegally entering the country will exceed any number that ICE may be able to deport; 4) none of us want to be in a position where our officers, who are already over worked and stretched thin, are asking individuals whom they encounter on traffic stops or for minor law violations for their “papers” because the individual has an accent or a so called “non-American” sounding name; 5) the well accepted fact that undocumented aliens often come from countries where law enforcement authorities are abusive and corrupt, and as a result many of those individuals have a fear of, and no confidence in, the police. We know that undocumented aliens are often targeted by criminals, because they know such victims are less likely to report the crime to the. My position is that when someone is the victim of a crime, it makes no difference where they are from or how they got here.
With the national, violent, crime rate climbing, our recruiting goals unfulfilled, our retention problems diminishing but not eliminated, and our authorized staffing less than what I believe it should be for a city with our population and dynamics, we are not in a position to devote police resources towards what is undeniably a Federal issue that no Congress or President in recent memory has identified as a matter deserving of the funds or manpower to adequately address.
We have gone to significant lengths with outreach to the Hispanic community in order to build trust and encourage them to report crimes if they are victimized. We have assured them that our officers will not inquire as to their immigration status unless they are suspected of being involved in one of the 5 activities enumerated above. This approach is not unique to Virginia Beach, but rather it is the norm among major cities I am familiar with.
I truly hope that those of you who take the time to read this have a clearer understanding of how multi-faceted this problem is. Lastly, for those of you who have decided to question whether or not our city is safe, suffice it to say that, according to the latest document released by the FBI – Crimes in the U.S. 2005 - Virginia Beach ranks number one as the “safest” city its size for cities with a population of 235,000 to 900,000. I attribute this to our active partnerships with the community and the efforts of the dedicated men and women of this department who strive daily to ensure that Virginia Beach remains a safe place for our citizens and visitors.

Three juveniles were flown to Inova Fairfax Hospital after a three-vehicle T-bone collision on U.S. 1 in Woodbridge on Sunday afternoon.

A little before 3 p.m., an SUV traveling north on U.S. 1 near Prince William Plaza ran into a car while crossing traffic to get into the plaza parking lot, Chinn said. After colliding, the two cars hit a third vehicle.
Police said the driver of the SUV, Roberto Martino Rodriguez, was drunk at the time of the accident and was charged with driving under the influence of alcohol. Chinn did not have his age and address at press time.
(Why not? Isn’t ones age and address normally printed on their driver’s license? Or does this guy not have one? I wonder why not?)

Maybe if your officiers weren’t out making “silly A** arrests” they’d have time to worry about ILLEGAL aliens.
Story:
July, 2006, Princess Anne Sports Complex, HOT 100 degree weather, a gentlemen and his wife were putting up a portable canaopy when asked by the park authority to take it down because of “liability” reasons. The couple refused stating the danger of the heat for the groups YOUNG children and ELDERLY folks out watching a girls softball game. The park authority called the police.
The police arrived and started speaking to the man about his canaopy. He was trying to plead his case about trying to get the young children and senior citizens out of the direct sun light.
The “park authority” returned and started laughing at the gentlemen who was being spoken to by the police. He proceed over to the “park authority” personnel and got in their face (did not touch them) and the police arrested him. The wife then asked the police why they were arresting her husband and they proceed to put the “matching silver bracelets” on her!
I was appauled at this RIDICULAS action as this gentlemen was trying to help those elderly folks and young children from the intense heat and sun. Shade was not available as to the way the “bleacher covers” are positioned for the time of day it was. Not to mention their daughter ran off the ball field in the middle of the game hysterical for both of her parents being arrested.
We had approached the park authority earlier in the day to ask about the canopy policy after we had been told we couldn’t put our canopy up for our girls. They said that the canopy’s had to be secured with spikes and that there were underground utilites and they could not allow spikes. (I thought code for underground utilites was a much greater distance than a 6 inch spike could penetrate). They would not allow us to put up the canopy without the spikes because they could “blow away” and cause harm and damage the grass. (I’ve been to HUNDREDS of ball games without a canopy “harming” someone WITHOUT SPIKES.) They would not allow us to put up the canopy’s on the hard top surface either…if we wanted to put up a canopy we could do so outside of the complex.
The police were also in the parking lot and called tow trucks to remove vehicles parked legally…i.e. there weren’t any yellow curbs or signs stating no parking on the grassy areas when the parking spaces were full. One gentlemen was forced to pay a tow truck driver $50.00 (after the tow truck driver had “jimmied” his door to put the vehicle in neutral) or he (the tow truck driver) would tow his car.
NOW YOU KNOW why Virginia Beach police don’t have time to enforce ILLEGAL immigration!!!!!!!!!
