Jeff Frederick: End Sanctuary Policies

Delegate Jeff Frederick is seeking to eliminate “sanctuary jurisdictions” in Virginia, which should really make the leadership in Fairfax and Arlington Counties howl. It’s long overdue.  There’s an article in the Washington Times about this, and below is Delegate Frederick’s press release:

Woodbridge, Virginia (August 23, 2007) — The first and only Latino elected to state government wants to crack down on Virginia localities that provide sanctuary to illegal aliens in Virginia.

Delegate Jeff Frederick announced today that he is drafting legislation that will prohibit any form of state funding to Virginia counties, cities, or towns that have policies in place that disregard a person’s illegal status for the purposes of providing services or engaging in law enforcement activities.

“Providing sanctuary to illegal immigrants in essence encourages illegal immigration, and it makes Virginia a destination for illegals. We want to stop these policies that invite people who are not legally present in the United States from coming to Virginia, and this legislation will put some teeth behind existing state law”, Frederick said.

Frederick’s legislation would be aimed at local governments who ignore the provisions of current state law that makes illegal aliens ineligible for state and local public benefits, as well as at those local law enforcement agencies that prohibit police from inquiring about a person’s immigration status. Frederick points out, for example, that Arlington County actually provides housing subsidies to people they know are illegal, and they forbid local police from working with federal immigration authorities.

Earlier this summer, the Prince William County Board of Supervisors approved a resolution that targets illegal immigrants by attempting to curb their access to public services and increasing immigration enforcement by local police. Frederick’s legislative district is located in Prince William County, and his legislation would have the practical effect of requiring every local government to act similarly to Prince William, or face losing state dollars.

“Illegal immigration is costing the taxpayers of Virginia a fortune, and it is harming the quality of life of our citizens. It’s time that we require our local governments to obey state law”, Frederick added.

Frederick said his idea is modeled after the federal government’s tactic in threatening to withhold highway funds to states that did not up the drinking age to 21. His legislation will be filed for consideration during the 2008 session of the General Assembly, which will convene in January.

While Frederick was born in Virginia, his mother — now a U.S. citizen — was born and raised in Bogota, Colombia where most of that side of his family still resides, including his grandmother.

If we can take this battle to the state level and win, we can fix problems in a whole lot of places in Virginia.  The only question about whether legislative efforts will be successful depends on whether Senator Ken Stolle and his cohorts will continue to roadblock any attempts to address this problem at the state level, if they are re-elected to the Senate in November.  Of course if they happen to be successfully challenged, getting things done in the General Assembly will be a lot easier.

    This is progress but still not good enough.

    US Constitution, Article 1, Section 8 describes powers that Congress shall have. It describes a number of powers but here is the text of Section 8 that I think pertains to immigration:

    “Section 8. The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;

    To establish a uniform rule of naturalization, and uniform laws on the subject of bankruptcies throughout the United States;

    …”

    Why isn’t the Federal government doing what it did with highway funds and under-21 drinking (a far less clear role of Congress under the Constitution than immigration)?

    Nothing good ever happens when states start taking responsibilities that should be federal. That’s because the states end up having their laws overturned by the wost enemy of The People - The Supreme Court.

    There’s plenty to lay on the heads of the Fairfax County BoS (like their Developerophelia) and the state stooges (like the transportation funding fiasco).

    However, the immigration issue should be hung squarely on the federal representatives.

    Fairfax resident: the feds lack of interest in enforcing immigration does not absolve local gov’ts of their responsibility. The locals’ mantra is that the problem is a national problem, not a local problem. No, let’s start at home PLUS vote out the worthless Webb and Warner.     Fairfax Resident: You should add George Allen and Tom Davis to your list of Federal Reprehensibles. The situation evolved on their watch, and I have not seen anything they (or the ones you listed) did to attempt to avoid it.

    Having said that, if the federal government is not going to provide for the safety and security of its citizens, the states and localities must. In a document penned some 231 years ago, it was asserted that it becomes the right of a people to provide for their own security when the sovereign fails its responsibility. The longest war ever fought by the American people was waged over that document. I hope it doesn’t come to that again.

    I just love this “it’s a federal problem, leave local elected officials alone!” argument foisted by many illegal alien apologists.

    When your house is on fire, and you’re waiting for the Fire Department to show up, aren’t you getting out your garden hose to try to do something — anything — you can do to help reduce the damage to your property? The Feds are the Fire Department, and no one knows when (or even if) they’ll ever arrive. In the meantime, we’re using the garden hose.

    And while we do so, it’s sending a powerful message not only to state, but federal lawmakers. Has anyone else noticed that the number of new amnesty proposals for illegal aliens being presented in Congress have significantly declined ever since localities started rising up in outrage and pulling out their garden hoses?

    Frederick did not mind the illegals who helped build his home as he and other claim all builders use. Frederick does not mind all the money he will make tax free from the sale of his home one day built by these illegal workers. Citizens do not want to use legal contractors to do their work because it ” costs too much” When will Frederick want to bring criminal charges agains the citizens of PWC and of N VA for paying cash for illegal work ?     Of course things cost more because of “legal” citizens working instead of the illegals. The problem isn’t that we don’t want to pay for higher salaries and healthcare costs, it’s that we would be paying more for their work and on top of that be paying for the illegals and everything that they suck from us for little to nothing.

    Illegal immigration isn’t wrong because people want a “better life for themselves” (oh a little tear and wimper of pity), it’s wrong because we are a country of laws and illegals don’t follow them, thus the using of the word “illegals”.

    We have people who feel bad for the aliens because they want to believe that there is no evil in the world and that people don’t lie about their true intentions, but the fact is there are evil people and there are bad intentions, and there is no way to truly protect ourselves if we look through rose colored glasses at all times.

    Take off the glasses and see the world for what it really is. And stop pretending to feel bad for them. They are lawbreakers and if this was someone who broke into your home to steal your food and furniture and tv’s, all with the “intention” to make a life better for themselves then you would want them brought to justice. But since this isn’t something that you are able to directly see or them breaking the law in regards to something tangible, you don’t think that they’re doing anything wrong.

    The figures given by BL have been all over the internet and is said to be the “INS/FBI 2006 quarterly report on undocumented immigrants” All I am saying is, that unsubstantiated information does not do those of us who are against illegal aliens being here, any good and may actually hurt our cause in the long run.

    The illegal alien apologists always say that the illegal aliens here pay taxes, work hard, have family values superior to Americans, and don’t commit crime. The one thing about these statements are, they can’t back them up.

    So unless we can point to an actual source I feel that we should not be putting figures out there. There are plenty of them, but these specific statistics can not be confirmed.

    Patriot, you have never backed up your facts with a reliable source. As you said it, it is much better if you sistematically document what your communities go through.
    You want to be taken seriously, then bring that reality to the people who don’t live there.
    By quoting these facts, you are just giving an excuse of treating you as ignorants.
    I like when Greg brings facts, not when he starts with the “boy lover “comments on when he just leave the blog when confronted with wrong facts (the Salvadoran TPS for example).
    Patriot, you have done the same thing. You insist on certain issues but when asked to prove it you don’t follow up. It is easy to continue pounding the other bloggers with the same song that illegal committed a crime and they will alway be guilty (discussion on the TPS for the Salvadorans).
    People use the term vigilantes with yoiu because the message is focused on the “feelings” that this issue brings rather than showing more facts.
    I appreciate Lafayyette, AWcheney, and Dolph for presenting that every day drama. They have showed me that there is a real person dealing with bthe bad side of the illegal immigration issue.
    Illegal immigrants are not the cause of all diseases. Think about it for a second and then see how some people make assess of themselves by supporting their arguments with those facts.

Keep in mind that regarding these crimes, which are 100% preventable if the feds had done their job, the most important statistic is that there is more than one American who is murdered by an illegal alien. That is outrageous, and entirely sufficient as an argument.

    We should not have a single American killed by an illegal alien. Period.

    Godd point Lovisa, but that argument is always ignored here. The next comment is always like this: one is to many because we could have avoided that crime by removing all illegal aliens.
    Almost everything seems to be fabricated and there is no dialogue. There are a coupl;e of regulars who are open to hear all popints of vies but is that minority.
    So Greg, what do you think about blacks killing blacks? You get rid of all the illegal aliens and what you have: people killing people. I support the arguments against illegal aliens when you talk about the problems of your community.

    Why do you have to say something about Carranza in New Jersey and nothing about the blacks or white killing people.
    I remeber that some people were saying that the guy who was arrested with explosives in Manssas was probably an illegal alien. When it was found that he was white everything was dismissed and people referred to him as disgruntled kid.
    When the crime is committed by an illegal alien is pure evil but when some else is found guilty then we blame external sources.
    By focusing on false statistics we are just feeding people with misinformation and distracting them from a reality
