Let’s Go To The Video Tape (#6)

Dave Ruttenberg has made an arrangement with his landlord to re-open Rack n’ Roll until it can be sold, and it’s driving the Manassas Park Police Department completely nuts. Not only did they make an attempt to do a sting two weeks ago in their typical Keystone Cops fashion, but just days ago, they tried it again. This time, they pick a different upstanding citizen to help them out.

Meet Christian Gates. When he’s not sucker-punching the women in his life, he’s a petty thief who likes to steal money from unattended cash registers. In the video above, Gates sucker punches his girlfriend, and the mother of his child a week after she’s given birth right out in front of the club after having an argument inside. Dave Ruttenberg has nineteen videos of this guy robbing the till at Rack n’ Roll over the years. Now he’s an undercover informant for the Manassas Park Police Department. He showed up at about 3:30AM last Saturday morning to have a talk with Dave Ruttenberg in a pretty silly attempt to provide enough probable cause for a police unit to raid Rack n’ Roll.

But first things first. At 3:25AM, when there’s usually no traffic in the parking lot, a vehicle arrives in front of Rack n’ Roll. We’ll call this “vehicle one.”

Two minutes later, it drives off and comes around the back of the club.

Two minutes after that, at 3:29AM, a U-Haul truck pulls up behind Rack n’ Roll. It pulls up just enough to get caught by the surveillance cameras.

Realizing that they’ve pulled up too far, about thirty seconds later it’s backed up so that it’s out of view. The shadow of the truck from a streetlight is visible at the bottom right.

At 3:30AM Mr. Christian Gates arrives in front of the club. He’s been barred from the place, understandably, so the manager alerts Dave Ruttenberg that this guy is here, and Ruttenberg walks out in front of the club to have a talk with him rather than allow this guy inside.

This conversation turns bizarre, with Gates trying to get Ruttenberg to admit to having done all sorts of things that never happened. He asks Ruttenberg if he somehow remembers conducting illegal gambling operations, having after hours stripper parties, drug dealing, and a host of other stuff. While they’re talking, here goes “vehicle number two”, at 3:48AM:

Ruttenberg plays with this guy for a while, and then finally starts making fun of him. When this happens, all the vehicles start moving again.

First, the U-Haul departs at 3:56AM.

Gates figures that the gig is up, and takes off. Ruttenberg figures that there’s something going on here, and goes out the back door with his manager to see if anything is happening out there. As soon as he goes out the door, someone in a little Honda parked in the back yard of a house directly behind Rack n’ Roll, and only about thirty feet from Ruttenberg, taps his brakes, giving away their position. Here’s Ruttenberg storming out to try and figure out what’s going on, at 4:02AM:

During the day, this is what the view out of the back door looks like. The City of Manassas Park has helpfully cleared out some of the underbrush from this private property earlier this summer so they’d more easily be able to conduct surveillance operations:

This car pulls out of this back yard and onto Scott Drive at 4:03AM, and vehicle number two immediately follows behind it while Ruttenberg brings his manager out back to see for himself what’s happening here.

This Honda then passes in front of Rack n’ Roll about thirty seconds later:

Now let’s break down what these vehicles most certainly are.

Vehicle one is a reconnaissance vehicle. It’s job is to cruise around and make sure that everything goes according to plan. The driver of this vehicle is a uniformed police officer, and if you look closely at the picture of it passing, you’ll notice the driver has a patch on his sleeve that is very similar to that worn by the Manassas Park police.

The U-Haul truck is a “jump out” vehicle with police officers inside. As soon as it gets the signal, the door rolls open and the officers inside can barrel through the back door of the club.

Vehicle number two is a “cover truck” that escorts the other vehicles as necessary. When the Honda leaves it’s position, it’s job is to “block” anyone following the vehicle. It has adhesive or magnetic “flashers” on it so it can display emergency lighting if required, and last evening it was back in front of Rack n’ Roll with four Manassas Park police officers while I was working on this story.

The Honda is a surveillance car that is recording audio from Christian Gates, and needs to stay within about 300 feet in order to pick up a clean signal, so it has to remain stationary.

At this point, you’re probably wondering, as I was, why this was happening, and appears to be continuing. Why would the Keystone Cops be trying to run Ruttenberg out of town when he’s in the process of selling his business and is soon going to not be any of their concern?

Manassas Park is scared. With their legal position crumbling, with Dean Crowhurst putting his foot in his mouth and begging for a major investigation to be conducted, and increasing numbers of residents beginning to question just what the heck has been going on, the window is closing on any opportunity they might have to trash Ruttenberg’s reputation and substantiate the detestable lies they’ve been promoting as truth. Once Ruttenberg is out of the picture at Rack n’ Roll, they can’t even try to entrap him any more. If they fail, they will not have persuasively substantiated anything they’ve said about him in the past. They’re pulling out all the stops, turning out anyone who has known Ruttenberg in the past and whom they can get leverage on in a series of last-ditch desperate attempts to arrest him on anything they can, and have some pretext to search his premises.

I went over to Rack n’ Roll last evening to pick up this evidence and see for myself what’s going on, and while I was there we saw the “cover truck”, the U-Haul, and a number of police officers staging something. As soon as Ruttenberg started showing me around, both vehicles and all the police officers left, all of which was caught on surveillance video. It looks like I just barely missed an opportunity to be there for something interesting.

This waste of public resources and outrageous harassment has got to stop.

    What will it take to stop this? I know for a fact it is in quite a few hands at the U.S. Justice Department and I know the FBI has most of this, but when will they make a move on these crooked officials?

    I only hope they are digging up so much stuff at every level of Manassas Park government that it is taking this long to bring them all to justice at once. Then the Manassas Park officials can see what it’s like to be on the receiving end of these massive raids. This one at least will be justified and a great way to get REAL crooks off our streets.

    Can you imagine if they put this kind of effort into catching illegal aliens committing crimes? Of course illegal aliens are strictly a federal issue.

    Patty: I know exactly where it’s going…right down the crapper paying for illegals and these kinds of shenanigans. This town will be bankrupt soon and it won’t matter anyway. No way, no how we can pay for the police station and the school with as many houses there are for sale or being foreclosed and nobody buying them.

    This is absolutely outrageous. Once again, people, we need an effort to pressure Bob McDonnell to appoint a special prosecutor in PWC and Loudoun to deal with these kinds of cases. We desperately need State Police oversight in addition to federal oversight since many of these crimes are state level offenses.

    Angered because David reported him to his superior, Lugo vowed in 2001 to “take David down.” Six years later, and with absolutely no evidence or reason to believe, during that entire time or now, that David engages in any illegal activity, he is obviously still trying, the fact that he’s a defendant in a $5 million Federal lawsuit notwithstanding.

    While I have never had much respect for the intelligence or the ability of the Lugo gang, you would think that they, especially Chief Evans, would have enough smarts to understand that, should David win in the 4th Circuit, the constant set-up attempts, including the videos, the participants, etc., are all going to be presented to a jury in the Eastern District. And, as for Mayor Jones, while he will argue that he was not the mayor when the 2 June 2004 stumblebum raid occurred (”gee guys, what happened to those two bottles of vodka our stooges put in there”), he can’t argue that he’s not responsible for the current Keystone cop activity.

    What really concerns me here, however, is the threat of violence towards David that the Lugo gang represents.They would love to see him hurt or worse and if anything happens to David you can bet that they will be the ones responsible. The FBI and the State Police are aware of what’s going on. They should take action to stop it.

    Bob McDonnell was apparently at the Manassas GOP HQ this weekend. Greg knew about it. I wonder why he didn’t ask him about this travesty and what he plans to do about it? Greg? Why bother even posting this thread if you didn’t confront Bob over this issue on Saturday when it would have been easy to get some face time with the man? Maybe you did, I don’t know? Apparently Bob doesn’t think they are doing anything wrong or he would have come down on them by now since this has obviously been going on in plain view for years.

I would urge you to contact the AG’s office yourself and raise concerns about what’s happened. The more people they hear from, the more likely it is they’ll take an active interest.]

    Park’d, this situation has NOT been in plain veiw for years…only since Greg started bringing it out into the light. What has been happening for MANY years is the malfeasance which has led to this. Given that the corruption has gone unabated in Manassas Park for decades, it’s not something that will be cleaned up overnight. That’s what happens when people turn a blind eye to what is going is going on around them.

    As soon as I have an opportunity I will be heading to Rack n Roll to check this place out for myself. I’ve already written McDonnell about Loudoun County (where we have a very special write-in candidate in the works), you PWC residents need to step up for your county. This is an absolutely huge civil rights case in the making. I agree with Golem that bad things are on the verge of happening and intervention is needed ASAP.

    That is Christian Gates assaulting his girlfriend.

    He was humiliated when the RNR owner, Mr. Ruttenberg, put this clip on a loop on the club video monitors for staff and customers to see.

    The management made a police report, including this video, that went un-investigated. No charge was filed against Gates.

    I just read through again and find it funny about the descriptions of Rack and Roll to be the same as Sharp Shooters when Chris owned it.

    Anyway, I don’t find it hard to believe some crooked stuff has been going on, nor do discount the stuff that is in question on this blog.( I am not full of info. or would be a good witness, but the time frame DOES mean something, as to the reputation of both places)

    I want to know and have asked ( gotten no answers)
    Why has anyone not contacted media such as 20/20 or Datleline, etc…
    until I get answers, I will not proceed with anymore research…why should I?

    Funny, how I find that Dave Ruttenburg and Christian Granville Gates BOTH were both charged with filing a false police report on 12/28/01.

    The outcome for Dave was Nolle Prosequi finalized on 4-18-02.

    The outcome for Christian was guilty on 7-28-03.

    What is going on?

    His ex-girlfriend’s name is Michelle. She coincidentally was jailed the same day he showed up at RNR (10/6/07). She is out now and currently waitresses at Sharpshooters

    Back to Manassas Park: The Arrest of David Ruttenberg

    I’ve written before that one of several reasons why I’ve come to believe David Ruttenberg is that after all of the entrapment, undercover operations, and harassment he has endured at the hands of the Manassas Park Police Department, the guy to this point has never been charged with a crime (the other reason I believe him is that to this point, everything he’s told me that could be checked out, has checked out).

    The never-charged-with-a-crime stuff, though, is not entirely true. Ruttenberg was arrested once, in 2002. But not for drugs, child pornography, or any of the other stuff Manassas Park city officials have accused him of, either officially or via rumor and innuendo. Ruttenberg was actually charged with filing a false police report. The details of that arrest constitute yet another incident of harassment of Ruttenberg at the hands of local authorities. Here’s the story:

    On December 28, 2001, David Ruttenberg decided to fire a guy named Rick Potter, a deejay who had been working at Rack ‘n’ Roll. David had noticed that Potter may have been coming to work high. He then began hearing rumors from customers and other employees that Potter was dealing ecstasy from the club. So he fired him.

    Potter came into work the next day, on December 29, and learned of his termination. Angry, he ran to the back of the club, yanked a mixing board out of the deejay booth, and darted out of the club with it. It wasn’t his mixing board. It belonged to a another deejay at the club, a guy named Christian Gates.

    Ruttenberg immediately called the police to report the theft. Gates signed an affidavit attesting that the mixing board was his property, and that he had never given Potter permission to take it. Potter was arrested, and charged with grand larceny.

    At Potter’s trial, his defense attorney approached Ruttenberg, and told him that Potter had a prior criminal record. Actually, a pretty extensive one. He had previously been convicted of stealing computers from a school, and had a 17-year suspended sentence hanging over his head. A conviction on this charge would likely send him back to jail to fulfill the rest of the sentence. Ruttenberg actually liked Potter (Ruttenberg’s biggest flaw, over and over again in all of this, seems to be that he’s too trusting and too willing to give second chances to people who don’t deserve them), and recognized that the guy was a mess. He didn’t want the theft of a mixing board from his club to ultimately put the guy away for 17 years, effectively ruining his life.

    So Ruttenberg approached the prosecutors, and told them that he no longer wanted to press charges. The state dropped its case against Potter.

    Ruttenberg would soon find out that Christian Gates changed his story. Despite signing an affidavit for Ruttenberg stating otherwise (see link above), Gates later strangely told police that he had given Potter permission to yank his mixing board out of the deejay booth and flee with it during business hours (sounds oddly like a guy pressured to change his story, doesn’t it? Who would give someone permission to do such a thing?)

    This was apparently enough for the police to charge Ruttenberg with willfully misleading them.

    On March February 11, 2002, Manassas Park Police Officer Travis Mosher (the same officer who would later release two men Ruttenberg caught doing cocaine in his club without so much as a summons, and who I would personally witness harassing Ruttenberg’s customers, in addition to other odd goings-on) came in to Rack ‘n’ Roll with a warrant for David Ruttenberg’s arrest. Officer Mosher then handcuffed Ruttenberg and frog-marched him out of his own business in handcuffs, in front of his customers and employees. For a misdemeanor.

    If you look at the arrest warrant, you’ll also notice that the officer who filed the complaint is named Howard Perry (weird side note: I’m told that Perry is the police officer who found John Wayne Bobbit’s severed penis on the side of the road).

    Ruttenberg’s trial was in April 2002. He attended with his father Neil Ruttenberg and his girlfriend at the time, Amber Lucas (I’ve also interviewed Lucas, and she confirmed this account of events). Ruttenberg’s case was toward the end of the day, and the courtroom was nearly empty by the time it was called. But let’s back up a bit. During the proceedings of another trial, Ruttenberg’s then-girlfriend Lucas recognized one of the prosecutors, a woman named Amy Ashworth. Lucas moved up to the front of the courtroom and sat just behind Ashworth, waiting for an opportunity to say hello. A short time later, as Ruttenberg’s trial approached, Lucas says she noticed Officer Perry sitting just to the right of Ashworth. According to Lucas, Perry leaned over, and said to Ashworth, referring to Ruttenberg, “This is a really bad guy. We need to teach him a lesson. We need your help getting this guy.” According to Lucas, Ashworth was surprised, and replied, sternly, “I’ll have no part of that.”

    This story comes via Lucas, a former paramour of Ruttenberg’s. So weigh it accordingly. I wasn’t able to get in touch with Ashford. Ruttenberg says she told she has no recollection of the conversation with Perry, though she didn’t deny it happened, either.

    Here’s another related harassment anecdote: Ruttenberg and Lucas say that one night at the height of the Rack ‘n’ Roll harassment, the couple was in the car kissing when Officers Perry and Mosher approached them. They knocked on the window, and amused, asked Lucas if she was really “with this guy of your own free will?”

    Ruttenberg, his father, and Lucas also say that just before Ruttenberg’s trial was to begin, four Manassas Park police officers entered the courtroom and sat in the back row, with broad smiles on their faces.

    When it came time for the trial, the prosecutor did indeed refuse to pursue the charges. She entered a nolle prosequi. Ruttenberg was free to go. The four police officers apparently left unhappy.

    Here’s where it gets even stranger. At Ruttenberg’s state Alcoholic Beverage Control hearing (remember, that’s the hearing resulting from the raid on Ruttenberg’s pool hall), Ruttenberg brought up his arrest as evidence that the Manassas Park police and city officials were out to get him. Bizarrely, Officer Mosher testified that he couldn’t remember arresting Ruttenberg. From the transcript:

    Q: Now, in March of 2002 [sic], did you go to Rack ‘n’ Roll and arrest David Ruttenberg for a false police report?

    Mosher: I’m not sure.

    Q: You don’t recall?

    Mosher: I do not.

    Hearing Officer: You don’t recall arresting him?

    Mosher: I don’t recall, ma’am. The reason I don’t recall is that I’m not sure if it was a warrant or something along those natures. I, myself, did not generate a case.

    Hearing Officer: Did you actually arrest him?

    Mosher: I don’t recall.

    Q: Is it your testimony that you did not show up and place David Ruttenberg in handcuffs and…

    Counsel: Objection to the characterization.

    Hearing Officer: He said he didn’t recall that.

    Q: He didn’t recall arresting him, wasn’t sure if it was a warrant. I want to know if he recalled putting him in handcuffs.

    Mosher: I do not recall.

    This is implausible. Ruttenberg’s name was the talk of Manassas Park at the time, and has been since. It’s a small town. And the police, including Mosher, were clearly fixated on Ruttenberg and Rack ‘n’ Roll. It’s just not feasible that Mosher wouldn’t remember arresting him and escorting him out of the bar.

    Thing is, it would also be a weird thing for Mosher to lie about. It isn’t as if there’s any question about who made the arrest. He clearly signed the warrant, and including his badge number, as the officer who executed the arrest. Ruttenberg’s customers and employees also witnessed the whole thing.

    The only reason I can figure he’d “forget” about the incident is that doing so might get him out of answering any probing questions about who instructed him to do it, and why.

    Now look at this. It’s a statement given by Angie Hoffman, a former waitress at Rack ‘n’ Roll, to a private investigator hired by the Ruttenbergs. Hoffman claims that about 3 1/2 months before the ABC hearing, Officer Mosher told her at a family barbecue that everyone in the Manassas Park police department knows Ruttenberg is a drug dealer (she also says she’s never known Ruttenberg to either use or distribute drugs).

    I’ve talked to several people around Manassas Park who tell similar stories. The town’s police made a habit of warning people not to visit David Ruttenberg’s club due, in turn, to Ruttenberg being a drug user, a drug dealer, a rapist, and/or a child pornographer. Of course, there’s no evidence that he’s any of those things.

    At the ABC hearing, Officer Mosher testified that he’d never heard of Hoffman.

    Here is the simple of it… I have lived in mp for 20 years. seen it go from what i considered small town quant, good ol’boy philosophy. to i don’t know what. The police do nothing about crimes that are reported by citizens for example assault, theft, vandalism, missing children, or sexual assault (teen girl in july) but if you have an airfreshner hanging on your rear view mirror you’ll be pulled over for obstruction of view. give me a break mp!
    I was recently told that pw county will be taking over is that true? is that in the works? i know they - pw- have taken over water and sewer, but are they taking over city government and police ? it could only be positive change as far as i am concerned.

    OMG!!!…..I have just seen this video for the first time. I totally forgot about this horrific event. It sickens me that the father of my newborn child would do such a thing. In on coming traffic no less. I had put this out of my mind and did not remember it until I saw the video. But that’s not the first time he had hit me. All I can remember is this intense pain in the back of my head and then seeing asphalt. Christian almost got his butt beat for that when the bouncer in the video pinned him up against the van. The bouncer actually put a dent in the van with Christian’s head.

    There are a few things I would like to say about Christian as it pertains to Rack-n-Roll.

    1. On numerous occasions within a 3 day period there are 19 times that Christian had stolen money from the register till. The manager at the time had just been diagnosed with emphysema and would loose consciousness. He volunteered to keep an eye on him. He was not supposed to be in the register period. He used this gesture of good will as an excuse to gain access to the RNR till. When Dave found out he barred him.

    2. I have seen Christian smoking marijuana in the back alley of the shopping center by the dumpsters. He also at the time owned a scooter and had a compartment in it full of marijuana and tried to sell it. His mother caught him with it and took it away.

    3. Christian picked the locks on the video games and display cabinets to steal money and employee shirts from Dave.

    4. Christian had been threatened by Rick Potter to say that he had permission to rip out Christian’s head unit to his DJ equipment during the Friday night DJ show. This lead to Dave’s arrest for filing a false police report. Christian had good reason to be afraid of Potter because he has hemophilia a rare blood disorder and one good punch could be fatal.

    As a result of being barred Christian had a grudge toward Dave and wanted to screw him over. He told me so himself. And that’s why he was at the front door of RNR trying to set Dave up last Friday night. I had no knowledge in advance of what he was going to do. I felt the need to say something about this whole “scandal” because Dave is a good friend of mine and doesn’t need Christian’s bullshit.

    I’d like an opportunity to create my own post so I can really go into detail about Christian’s conversation with Dave at RNR last Friday night. And I’d like to post the actual audio so that everyone can hear Christian’s line of crap.

    This type of outrageous behavior seems to be catching on in other small, (formerly) quaint cities. Fairfax City isn’t using the same tactics but it’s certainly trying to achieve the same results… eliminate small businesses they don’t like. Chris at Mason Conservative is trying to bring this to the attention of the public (see link for details). I sure hope the Fairfax City fiefdom doesn’t start reading BVBL and get any ideas from Mananssas Park…

    Have you pressed charges against Christian?
    I saw his rap sheet thru PWC ( includes the city of and MP) ONLY….
    WOW is all I can say….I think I stopped counting at 49 entries.

    What he did to you is so wrong and your right, it took you SEEING the video for yourself….he attacked YOU in front of ONCOMING traffic!

    I was vaguely aware of all of this scandal back when it was first happening, but then I went off with the military and forgot all about it.
    I do remember the thing about the drug bust, though. But at the time it was just a crazy rumor nobody could substantiate.
    I do know that the last time I stopped by R&R a few months ago on a saturday night the place was dead. I asked for a beer and a table, and the guy behind the counter says “Sorry, no beer, we lost our alcohol license”. And I respond “How the hell do you run a pool hall without a liquor license”
    He gestures around the empty place with his arm saying “We don’t”.

    It’s a shame too. A bunch of us used to hang out there all the time a few years ago.
