Republicans Pre-File Illegal Alien Bills

This is the time of year when members of the General Assembly pre-file their bills, and a number of these that address the illegal alien issue have recently shown up on the Legislative Information Service (LIS) website. There are some really good proposals here which are sure to be rather popular with the electorate, but which are going to need citizens to get involved in the legislative process in order to make their way through the General Assembly and to the Governor’s desk. More bills certainly will be filed, and many of those that already have been filed are not yet listed on LIS.
Here’s what’s showing up so far:
HB 14 (Delegate Chris Peace-R) will ensure that illegal aliens do not attend taxpayer-supported Colleges or Universities.
HB 28 (Delegate David Bulova-D) will allow vehicle title applications without Social Security Numbers, if the applicant has a drivers license already.
HB 45 (Delegate Robert Tata-R) will make assisting illegal aliens for benefits which they are not legally entitled to a crime.
HB 47 (Delegate Mark Cole-R) will not allow illegal aliens to obtain bail.
HB 51 (Delegate Scott Lingamfelter-R) provides legal immunity to those enforcing immigration laws in Virginia.
HB 55 (Delegate Scott Lingamfelter-R) requires the use of English by government, with a few necessary exceptions.
Of note, no bills regarding the illegal alien issue have yet been listed from the Senate.
This will be an interesting list to keep an eye on. Will Democrats who took a good stand on this issue fulfill their campaign pledges and introduce some bills? Within the next few days we should have a good idea whether this will happen, or whether Republicans will be the only ones who are interested in addressing this issue.

Colgan better be on board, considering his campaign promises.
HB16 Credit reports; authorizes an individual to freeze access thereto. Man this one is overdue and key to protecting citizens from those who would steal our identities and trade on our names and reputations we have worked hard to earn and build
I hope Senator Colgan proposes a bill to crack down on illegal aliens.
Delegate Scott Lingamfelter-R) provides legal immunity to those enforcing immigration laws in Virginia. — How is the State going to give immunity to state or local police when the federal goverment charges them with a civil rights violation if it goes that route. And most of them will. More smoke and mirrors.
(Delegate Scott Lingamfelter-R) requires the use of English by government, with a few necessary exceptions. — English is already the offical language of VA. I do believe federal law requires goverment forms be printed in languages where the population of certian non English speaking group is over 5%. There one incident in NYC where a hospital had to hire an employee who spoke an obscue African languge because someone came to the hosipital who also spoke the language and no one on staff could help the person and he sued. FEDERAL LAW.

The text of Tata’s HB -45 bill reads: Provides that any person, knowing an individual is an alien in the United States unlawfully, who, with the intent to violate the immigration laws of the United States, fraudulently assists the illegal alien in acquiring or attempting to acquire a benefit, service, status, or privilege to which the illegal alien is not lawfully entitled, is guilty of a Class 1 misdemeanor.
Please explain how that law would encompass the “poor cleark who looks at fake ID’s and in good faith gives the person benefits.”

Not sure why HB 28 is on this list. My understanding of its intent has nothing to do with illegal aliens, but rather has to do with the continuing trend of not using SSNs as identification on public documents. HB 28 allows a resident to title their vehicle using their state-assigned DL number in lieu of their SSN. In these days of rampant identity theft, that’s an important change.
Including it here you are implying that Bulova is attempting to make it easier for illegals to title vehicles. That’s not what HB 28 does since one must prove legal residency to receive a drivers license.
HB 55 is not an anti-illegal immigration act. In addition to the point made by anonymous above, HB 55 would also hurt the tourism industry in the state, making it illegal to provide signage and other documents, brochures, marketing materials, etc., for state- and local government-operated parks and tourism sites and destinations. It would also prohibit economic development agencies from printing and distributing marketing materials to attract foreign business and investment. The Fairfax County Economic Develop Authority, for instance, maintains overseas offices to attract foreign businesses to Fairfax County. Some of their materials are written in the language of those foreign countries. Finally, this is just a stupid bill. The major exceptions mean that all those places so many people are tired of seeing alternate languages will still be there. This one is smoke and mirrors to make it look like someone is doing something.
As with all new bills, beware of potential unintended consequences.

I didn’t have to prove legal residency to get the VA driver’s license I currently have.
I’ll let you figure out how that might be possible.

To get a Virginia Driver’s License, you are required to bring and show identification that proves legal presence, Virginia residency, and your SSN (if you’ve been issued one). The exceptions to this is someone born in 1937 or earlier who has held a Virginia Drivers License that is current or expired less than five years ago. This is for new licenses.
For renewals, if you have a valid, unexpired license issued before 1/1/2004, you do not need to provide proof of legel presence when renewing your license. 1/1/2004 is the date the legal presence requirement became part of Virginia law.

So, the Chairman of the Democratic Party Howard (WHO-YAHHHHH) Dean calls the term “illegal aliens” “outrageous”!!! All Dems on this blog who feel otherwise, please write to Mr. Dean and show him why he is wrong. Even if he is only saying that for political posturing, it’s a very dangerous thing to say.
Kind of like a sitting Republican President who wants to go soft on the illegals. And speaking of President Bush, let’s write the White House asking that he “immediately commute the prison sentences of two former U.S. Border Patrol agents convicted in the shooting of a drug-smuggling suspect” as put forth by Rep. Bill Delahunt, Massachusetts Democrat . I guess it IS true what they say about broken clocks!!!
Turn PW Blue - have you ever had the misfortune of LOSING a driver’s license and trying to get it replaced??? The lady at the counter gave me nothing but greif (I had my birth certificate in hand as well as a utility bill and my vehicle registration).
I told her my license plate number - not good enough. I told her the make and model of my 2 previous cars - not good enough. She asked me if my last DMV transaction had been at the DMV or online and what type of transaction it had been. When I answered incorrectly she told me there was nothing she could do for me, I had to show an ID with picture, the birth certificate was not good enough without picture. I told her that I had changed a bit since 1966, she failed to see the humor.
I then demanded of her to see her supervisor and she told me that she would go back to talk to him. He rolled his eyes at her and told her to give me a new license. Once it was printed (no new picture was taken) MY picture taken a year prior was on the ID. Amazing, she could have done that from the get-go and seen it was me. Who knows, maybe since I did not have Neve Campbell next to me she did not believe who I was - lol

John Light - That DMV treatment would be pretty aggravating. The worst I’ve had to deal with so far is lines, but I think I would lose my mind if what happened to you happened to me, particularly when she could have solved the “problem” right away but chose to defer for the sake of convenience.

Indeed, I got my license long before 1/1/2004.

Not sure I understand your point. It should be difficult to get a replacement driver’s license without adequate documentation. YEs, in your case the fact that she had your picture in front of her was ridiculous, but flip the story a little. What if a person went into DMV claiming to be you with a forged birth certificate and/or SSN card (with no photo ID) claimed he had lost the license? Thus the requirement for a photo ID. The law is pretty clear on the documentation required for renewals, reissues, and new licenses. Or are you saying that the “rule of law” is flexible in its interpretation and how it is applied? *G*
And I did lose my license once. I used a photo ID from my employer and my birth certificate to get a duplicate. It wasn’t a pain for me because I brought the documentation the law required.
