Colgan Introduces E-Verify Bill

Apparently, not all Democrats are following the lead of those such as Democrats on the Loudoun Board of County Supervisors and Arlington Chairman Walter Tejada in trying to align their party with illegal alien lobbyists. After hearing from constituents in his district about their concerns about illegal immigration during the elections and seeing the success of other states, Senator Chuck Colgan introduced SB90 which will require that all employers in Virginia verify the legal status of their workers using the federal E-Verify system. This is a very welcome development that may help to redeem the Democratic Party in the eyes of many voters, and Colgan’s senior position in the Senate definitely helps improve the chances of this legislation making it to the Governor.
The E-Verify program allows participating employers to verify that an applicant’s Social Security Number is valid and assigned to the individual applying for a job, which makes it tremendously more difficult for illegal aliens to employ fraudulent documents, and for employers to ignore fraudulent documents when presented. Current law doesn’t require that employers reject obviously fake documents or attempt to validate the authenticity of documents used to complete an I-9 application. With an easy to use tool such as the E-Verify system, employers won’t have to authenticate documents since the Department of Homeland Security, which operates the program, will provide validation for the information contained in a document. It’s much easier for employers, and it works far better than the broken I-9 process.
Arizona passed it’s “Legal Arizona Workers Act” which went into effect on January first after surviving a legal challenge by “Chicanos Por La Causa” and “Somos America”, and as a result illegal aliens are leaving Arizona in droves. Oklahoma passed House Bill 1804 in 2007 with similar provisions, and is seeing exactly the same results. There are a growing number of states considering legislation which will make it much more difficult for illegal aliens to unlawfully reside within them, and Virginia may well join in and finally adopt this much-needed legislative reform which has already proven very successful elsewhere.
SB90 establishes that hiring an illegal alien will be punishable as a Class 1 Misdemeanor, a rather significant penalty, but does not provide for revoking business licenses for repeat offenders as is the case in Arizona’s law. It’s quite likely that an amendment to include such a provision will be offered since that proposal has already been offered in other pieces of legislation, and SB90 may well become the vehicle that will consolidate much of the employer sanctions for violating employment laws in regards to illegal aliens.
This is a significant piece of legislation which should obtain wide bi-partisan support not only because Virginians overwhelmingly approve of measures to combat unlawful employment practices involving illegal aliens, but because the chief sponsor of the legislation is the Senate’s most senior member and chairman of the Finance Committee. If Chuck Colgan does a good job of promoting this initiative among his colleagues, this should rocket out of the Senate and would almost certainly be approved by the House. It will still have to make it out of committee, but with Colgan as sponsor and a member of the first committee that will consider this, chances for this kind of reform have rarely been more favorable.
The bill is now before the Senate Committee on Commerce and Labor, chaired by Dick Saslaw who probably isn’t all that supportive of the bill, but between support from Colgan and a strong constituent response, this could well pass out of this committee, which is comprised of the following Senators:

Chuck Colgan deserves a big thank you for introducing this, and Virginians should be contacting their elected officials in the Senate, urging them to support this important bill. If any of these are your Senators, drop them a line and tell them to support SB 90.

It’s a great step, but I wish the penalties for not using E Verify and knowingly employing illegals was greater. A class 1 misdeanor can still result in a slap on the wrist or a miniscule fine. It’s fine to hope and speculate that an amendment will suspend or revoke the business licenses of violators. I will save my celebration for if and when such an amendment is added and the bill becomes law.
Even if the bill passes, it would still require No Brain Kaine’s signature, and we know his illegal alien track record.
I did a “fly by” not too long ago. Now, I guess I now know what the aroma in the air was. lol
I did see a truck door open, but then as I flew closer I saw the driver getting out. I think they were comin’ with the fixin’s for supper.

Chuck has really stepped up to the plate. I hope this makes out of committee. That was a big problem last year. Chuck is well respected if anybody can make this work, it’s him.

As long as it gets out of committee, we will be better off. I am afraid this may be nothing more than a flash in the pan. Something he can sign off on as putting forth the facade that he did try, but the committee killed it. I will not get too excited until he starts fighting for it in the open.
It would have surprised me if Senator Colgan went back on his promise to his constituents. However, I did take the wait and see approach with Colgan. I’m ecstatic that he introduced this bill.
I also would flood ALL the Senators on this committee with the usual, phone, fax, email. Let them hear that Virginia citizens want something done about illegal immigration NOW! Let Virginians do to the State Senate, what Americans around the nation did when amnesty for illegals was introduced.

I think the best thing to do would be for individuals to e-mail each and every Senator to support this bill. Not a hard thing to do. Less time than some inane posts, anyway.
This is Senator Colgan’s final term - so be assured that
he is not acting with one eye on the next election,
but doing what he believes is best for Virginia.
But, of course, that is what Chuck has always done.
Why is everyone ready to thank him? All he has done is introduce a bill, he has not fought for it yet. Let’s wait and see how this plays out before we get to jumping up and down with our hands waving in the air. While this is a positive step in the right direction, I am not impressed until I see him fight for it.

I would love to sometime. I am not as familiar with him as you are. I go on past performance of most politicians, they are a flash in the pan and act like they are getting things done, when they actually just rest on their heels soaking in the warm light of the public eye.

You can be sure this bill will be heavily opposed by the recently formed Virginia Employers for Sensible Immigration
Policy. It’s mission is to thwart legislative efforts to crack down on businesses hiring illegals in order to protect their low-wage workers. Members include some of Virginia’s most influential industries, including home builders, contractors, hog and poultry growers, retailers, truckers, the hospitality industry and the state Chamber of Commerce. So this bill will be a big test of their power.
I am personally waiting for a Patriot list in regards to the bill LOL…

There was one last year that imposed fines…. My understanding was that the head of the commerce committee was against it. The two girls that were killed in VA Beach were his constituants. Glouchester, if I am correct. Anyway, Jeff Frederick told me that perhaps it would be different next time around.
Personnally, I going to continue to discuss these things with Jeff Frederick and see how I can best support him to get some things done.
For those that are beyond simple and shallow summations of politicians, he is verrra responsive and verra interested in best serviing his constituants. I am sure he would be happy to hear from everyone.

Sorry, I think I left you off the walking wounded list back from November.
I’m not going to go over old stuff other than to say that I was at Colgan’s debate with Fitzsimmonds and he did sound like an illegal alien apologist (”gentlemen at 7-11 are here legally”). I’ve been willing to give him a fair chance. I went to two meetings that Colgan was to appear but he didn’t show for either of them. He was to be at the town hall meeting at the McCoart building but didn’t show up. I’ll be honest. I was disappointed especially since Senator P. showed up.
I’m still willing to give him a fair chance. I’m glad he introduced the bill. I will call him up to thank him. I would also like to see him fight for it as the others have said. I would hate to see this die in committee. Wouldn’t you?

Seriously, wouldn’t federal tax law take over at this point? Payroll include federal taxes, taxes require filings. I like to think that we have a few laws on the books that would come into play.
I understand that there are groups which will oppose this proposed bill in order to keep hiring illegal aliens at below market wages. However, they must have a better public argument than “we’re greedy”. What do opponents of this proposed law say when they publicly explain their opposition?
I sent Colgan an email and thanked him for the glimmer of hope. I urged him to do all that he could to see that it passes and becomes law.

Let’s save the pats on the back until the legislation is signed. If it passes, then thank him. Are those of you who want to rush to congratulate him now going to condemn him if he does not truly push this? Seems like a lot of folks are in the “I told you so” line prematurely.
This is simply a small step. There is MUCH more that needs to be done. If Colgan is finally on the right side, there should be much more action taken here.
The senior senator should be able to get this through if he truly beleives in it.

I am happy that Senator Colgan has introduced this bill. I am currently using this program within my own small business as I want to ensure that I only properly hire my new workers. The Federal E-Verify is a good start, but I think that it has some inherent flaws.
The two primary issues that I have with the E-Verify system are:
- You cannot check on existing employees, only new hires.
- The earliest the employer may initiate a query is after an an individual accepts an offer of employment and after the employee and employer complete the Form I-9. The employer must initiate the query no later than the end of three business days after the new hire’s actual start date.
If the system could be changed to fix these problems, we employers would be better able to positively and quickly verify an employee’s status.

Everyone should contact their state senator and ask them to co-sponsor this very important legislation. We need enough support to override Kaine’s VETO.
It seems to me that politicians are a good bit like children in the respect that rewarding good behavior begets more good behavior…to continually condemn, without reward for good conduct generally results in “deafness.”
Although not my senator, Sen Colgan’s action is a good first step that should be recognized as such…thank him for this and he may listen and support us even more.

There is no technical reason why the E-verify system couldnt be used for current employees right? Its just a legislative issue?
Although E-Verify (the basic program) can be manipulated in some ways, it is a step in the right direction. What would be especially interesting is following the financial backers of GA members who vote AGAINST this bill.
Illegal aliens are uneducated - they are not stupid. Since E-Verify has been bounced around, illegal aliens have also taken steps to thwart the program to their advantage.
Hospital OB staff have posted on a number of blogs that more and more babies born to mothers without insurance or documents are recording names on the birth certificates that are the same as the mother, father, sister or brother. After the child receives his/her SSN, the parent or relative then uses the card as employment eligiblity verification. Because the SSN is genuine (i.e. valid) and the name matches the birth certificate from their country, it will slide right through E-Verify without a hitch.
In 2006, about 1 million babies, listing ethnicity as Hispanic, were born in US Hospitals, based on hospital birth reports provided to the federal goverment. These reports do not specify if the mothers are legal residents or illegal aliens.

As I remember the promise if Chuck didn’t keep his promise I would be protesting right beside you. Step 1 in keeping the promise is complete.
I think Chuck gets more the 75% of his legislation through. The interesting think will be to see how the House Votes.

Not at this time. The program (at this time) is designed only to match the name to the number.
This may be why it has been proposed the new National ID card with an imbedded a biochip. Biochips apparently are cheap and reliable and most businesses can afford the readers, vs eye or finger print.

I wonder how many illegal aliens are naming their babies after mothers and fathers and using their SSN#’s to work. This is very frustrating to hear. We have trouble getting to step one (E-Verify) and they are already 3 steps ahead. Not only are they working using those cards, but they are contributing to their own babies social security accounts. Social Security should be able to see that these babies are “working” and do something. Do the illegal aliens also use these SSN (baby) cards to get driver’s licenses?
I think Obama Hussein with his experience as a Black Muslin can bring the extreme Arab Islam Muslins into the Party as well as the Black Muslin hate groups and expand the Democrat party. I am hoping as a experienced drug user Obama and as he says knowing how to score some blow he will address how backward our drug laws are and legalize drugs also. This would release millions of Drug users and drug dealers from prison. They with their knowledge could go into selling, distribution and expanding the legal drug trade and help our economic. Not to mention saving tax payers Billion now spend in incarceration, and drug fighting cost. This would reduced the price to where average Americans could afford good coke, just not the elites and Politicians, This will also reduce the price of creak also for our poorer citizens, and make their life more enjoyable. starryflights a SSN and utility bill are all DMV requires for a driver’s license. That’s scary enough, but what makes it even scarier is after they get their drivers license (with the baby’s SSN), they can then walk across the room and register to vote.

we could donate sneakers to any illegal that decides to make a run for the border (on this side of course). If we can find enough of them, I would even follow them along their trip to ensure they make it safe

During a insurance checkpoint in my neighborhood a week ago I watched a couple of hispanics get stopped and they got out of their car and made a run for the fence, jumped it and headed into the woods, leaving their car behind. Too dark to tell if they were wearing sneakers, but saw their faces in the cop spotlight. Cops said they were illegals, names they gave was already in the system as illegals.

What we really need is in car electronic fingerprint devices. The technology is there with the FBI. Names are too easy. Afterall who is Juan Valdez. Then, we need to be strong. Deport illegal aliens, prosecute businesses that hire illegal aliens, and deny services to illegal aliens. Tell me why an illegal alien is entitled to a Virginia Drivers License??

I just read “The Deporter,” by Ames Holbrook. Have things changed or is it still the same, I wonder? In the book, Ames a deportation officer (they may now be called ICE), would catch and mostly release illegal aliens. They had so many days to deport them. Most illegal aliens refused to give passports or birth certificates and the countries of origin made it very difficult, if not impossible, to deport these illegal aliens back home. Many times these rapists, murderers and mentally ill, etc. are just dropped back off onto our streets. Many have not even served their full sentences, as communities across the country try to save money by giving up these illegal aliens to ICE to supposedly deport, only it’s not working. Our government (again) refuses to put any teeth into helping to deport these illegal alien hard criminals. We could and should refuse to give visas to all countries that will not take back their illegal aliens. I wish ICE would release these criminals in the back yards of our government representatives. How quickly things would change.
