McDonnell Kicks Out Illegal Alien Sex Offenders

Proving our suspicions correct, Attorney General Bob McDonnell announced today that 135 sex offenders currently held in Virginia’s prisons are in fact illegal aliens and has engaged in a joint operation with Immigration and Customs Enforcement to identify and process for deportation these criminal illegal aliens. Since there is no comprehensive approach to screen for illegal aliens and process them for deportation outside of a handful of localities in Virginia that have enrolled in the Section 287(g) Program, had the Attorney General not taken the initiative to conduct this operation ALL of these illegal aliens would have been released back into our communities after they had completed their sentences and would have been placed on the Virginia Sex Offender Registry. This is a tremendous public safety improvement, and Bob McDonnell deserves a big thank you for addressing this problem despite the Governor’s intransigence in even acknowledging the value of systematically screening for illegal aliens in our prisons.

An additional thirty six illegal aliens who had been released from prison and listed on the Virginia Sex Offender Registry have now been taken into custody and are facing deportation proceedings as a result of this operation. Until now, because Governor Kaine had refused to enroll in the Section 287(g) program, it had been the policy of the Commonwealth of Virginia to release illegal aliens who had been convicted of sex offenses back into our communities. Finally, we’ve taken the glaringly obvious step of having these illegal alien ex-convicts rounded up and turned over to ICE for deportation.

This clearly demonstrates how important it is for the Commonwealth and all of it’s localities to enroll in the Section 287(g) Program at the very moment when the Senate Courts of Justice Committee is considering HB 623, which would direct the Governor to enroll the state in this program. If Virginia had enrolled in this program, we wouldn’t need to have special joint operations with ICE to figure out who in our jails are illegal aliens, and get them deported. This would be happening as a matter of course, and we would never be releasing illegal alien sex offenders into the community in the first place.

While the value of these special ad-hoc enforcement efforts is clearly proven by this effort, these depend on ICE having the time and resources to commit to these special operations. This effort could end any time that ICE determines that they don’t have the manpower available to devote to this effort, and then, because the Governor and much of the Democratic Party leadership is steadfastly opposed to enrolling the commonwealth in the Section 287(g) Program, we will resume our previous policies of playing catch-and-release with criminal illegal aliens who commit sex crimes in Virginia. Before this happens, and it is only a matter of time until it will, we need to get the Commonwealth and every locality within it enrolled in the Section 287(g) Program.

I hope Senators on the Courts of Justice Committee have heard about this, because if they vote down HB 623 today, they’ve just positioned themselves as the root cause of what the Attorney General managed to fix today, despite them. This story will be a millstone around the neck of every legislator that opposes efforts to deport criminal illegal aliens, and is a perfect weapon to beat Dick “We will do nothing” Saslaw and his ilk about the head over the next three years when the Senate’s illegal alien caucus will have to face the voters once again.

In addition to those criminal illegal aliens listed above, this effort managed to identify a bunch of illegal aliens who had recently committed crimes while this operation was underway, and lists their offenses. Here’s the list. It’s quite an eye-opener:

    FYI: The article states that 135 sex offenders in VA prisons have been identified as being illegal. That means of all the sex offenders in VA prisons 135 are illegal. Would you agree there are more than 135 sex offenders in VA prisons?

    It doesn’t matter Anonymous…they can still be deported, even if they are naturalized citizens, if they commit a serious offense. As a naturalized citizen myself, I say “Bob McDonnell…go for it!”

    Unfortunately, what is to keep them from coming back across our open borders?

    Seems like they would be better off kept in prison, unless this process is akin to extradition. I hope a prison cell in Guatemala or Ethiopia awaits them.

    The only difference is that the CRIMINAL illegal aliens have been caught committing other crimes. The act of entering the U.S. without being admitted is a crime. They just haven’t been arrested yet.

    I did not know that! I checked and you’re quite correct. Naturalized citizens can be “denaturalized” and deported. Interesting.

    Criminal Aliens are any non-US Citizen who has been CONVICTED a felony. Illegal Aliens are those who have violated US immigration law, and may or may not have been convicted of such. Regardless, and illegal alien is guilty of at least one crime, by there continued presence in this country.

    The point of this post is that without 287g a suspect’s immigration status (whether here legally or illegally) isn’t known. Without 287g, even someone here legally on a VISA would be relaeased into the community after their time is served. Even if someone is here on a VISA, if they commit a serious crime (Rape, Murder, aggrevated assault, Robbery), they should be deported after serving their time.

    US immigration policy should be selective. The US should be able to pick and chose who they let into this country, and who can become a citizen. Come here legally. Work hard. Play by the rules. Take full advantage of the opportunities this country offers.

    Yes. This is true, but it is VERY rare that citizenship is revoked. The cases I am aware of revolved around people who were granted citizenship under false pretenses, like Nazi war criminals who emigrated to the US, and entered under an assumed name, or people who lied about being fugitives from legitimate justice in their home countries.

    There was a recent case of a women who entered a shame marriage in order to gain Citizenship, she was given the boot even though she was Naturalized.

    Boy, do I love how the COMPOST put a spin on the deportation story. I suppose Greg has a better connection with law enforcement, since the COMPOST said the report did not contain the addresses of the offenders.

    I am trying to understand the facts in this story. Are the 135 sex offenders in our system all illegal, or foreign nationals, some of whom are illegal? Ditto for the 36 sex offenders who have been released into the community and are on the register.

    My point is that ALL foreign nationals who commit sex crime should be deported. No criminals should be allowed to stay here, regardless of immigration status. In addition, if the commonwealth would pass legislation that would make it next to impossible for illegal aliens to live and work in Virginia, we could avoid many of these crimes int he first place. People who break the law just be being here are willing to break other laws.

    This is a great start, and Attorney General McDonnell should be commended for taking action to make Virginia safer for women and children (who make up the majority of victims). Virginia residents have been begging for this, and finally somone took positive action. All the while the senate and governor are still ignoring the problem.

    Those deported have been both legal immigrants and illegal aliens. I don’t think the Commonwealth is positive of the exact number of legal immigrants and illegal aliens that are currently in the prison system and who might “qualify” to be deported using this program.
