Immigration On The PWBOCS Agenda Today

NBC4 is reporting that Prince William County Chairman Corey Stewart will propose an amendment to the county’s policy to uphold the rule of law at today’s 2:00 PM session of the Prince William Board of County Supervisors.  The reported change involves establishing a “reasonable suspicion” standard to determine when officers could check the immigration status of a suspected illegal alien which is easier to meet than the county’s previous “probable cause” standard.  I really don’t see this changing a whole lot, since under the revised resolution officers had the power under 8 U.S.C 1373 and 8 U.S.C. 1644 to use their discretion in conducting checks anyways.  It’s not a bad idea to provide clear direction to the Police Department in this regard, since without it who knows what standards would be established, but this is certainly not the groundbreaking change that the illegal alien lobby seems to think it is.

The revised resolution, drafted in closed session by the County Attorney in violation of Virginia law regarding open government, not provided to the public during the meeting of the board when it was considered, again in violation of Virginia law, and then deliberated during a “recess” of the board which was for all intents and purposes another unlawful closed session, was confusing to many.  The language of the revised resolution seems to offer something for everyone, prompting a huge amount of confusion by the media and the public, which might have been avoided had the board followed established policy and voted on the measure at a subsequent meeting, which is the established policy of the board.  Instead of correcting that confusion, and some potential legal problems that the adopted language may have introduced, we’re nibbling at the edges establishing a legal standard for officers to employ when all we really needed to do was cite existing federal law that leaves the decision about whether to question a suspected illegal alien about his immigration status to the officer.

I understand that there will be a report by the Police Department about the number of illegal aliens the police have identified, and perhaps the new General Order that implements the Board’s recent policy adjustments. Those items on the agenda are likely of far greater significance.

UPDATE: Any modifications to the Rule of Law Resolution as well as the draft of the Police Department’s General Order are going to be deferred to June 3rd.  Hopefully this will allow greater public input on any changes that will be considered.

    Sounds like a good idea. But I can see them coming up with a huge cost associated with doing this (inquiring of everyone’s legal status) and the illegal immigration lobby using that to argue against it. Although, presentation of a valid driver’s license should be enough in response to a query of immigration status, so maybe the argument could be made in most cases it wouldn’t take up much of the officer’s time.

    All persons should be asked - because illegal aliens come in all ages, shapes, sizes, and colors. I would be grateful if I was stopped and the police asked me my immigration status. Everyone should be asked!

    Why all this crap? Because you can’t stand having to deal with new neighbors who are acting in ways that you don’t like.

    The only people who would be against such a policy are those who want to turn your neighborhoods, the county, the Commonwealth, and the Nation into a third-world slum like you’d find across the border in Matamoras or Juarez. They hate this country and see uncontrolled invasion by illegals as a quick way to disrupt its economic and political structure. They have no real affinity or sympathy for immigrants. To them, immigrants are just another tool they want to use to accomplish their purpose to subvert and overturn our form of government and social structure. These are the same people who have been trying one way or another since 1967 to destroy this country. They cannot engage in a reasoned discussion with us on the issue so they resort to ad hominem attacks on our reputations and character, which are not going unnoticed. This is only a skirmish in a larger war, but we should not diminish the import of the skirmish. It’s being watched all over the world.

    If you’re not suspected of committing a crime or civil infraction, Nick, you probably would not encounter and be detained by a police. However, if you run a stop sign, or are found standing over a dead body with a smoking gun, the detaining officer should inquire about your legal status, regardless of your color, accent, clothing, etc.

    The State of Virginia has consistantly voted down any effort to require by legislation that the citizens of this state be required to identify themselves to the police using a photo ID. State law only requires you provide an officer your name and address.

    Anything else and I’ll leave to any lawyer to fight the county for a nice sizable settlement. I believe our county has lost sight of the Dillon Rule.

    Regardless, I recommend even if this legislation passes that a person just WALKS AWAY as you are not required to stop if an officer only has reasonable suspicion. Any attempt by a police officer to hold a citizen under reasonable suspicion can be deemed unlawful detention or assault and use of force against the officer is legal under self defense doctrine.

    If the enforcement of immigration laws was entirely up to the Feds and them only, why on Earth did Congress pass the 287g program?

    By the way, Fairfax County is suffering housing foreclosures and hard economic situations (Conolly wants to raise taxes and buy up foreclosed homes) and they don’t have the Rule of Law resolution. How do you explain that Nancy?

    It is hard for me to believe that the County actually employed you to work in the school system.

    Driving is a privledge granted to you by the powers of the State. Walking around or hanging out at a local 7-11 or a Home Depot without identification and refusing to show them to a peace officer is our collective right.

    Any country, state or county that wishes you to show identification for every activity that you have a God-given right to perform is one step removed from tyranny and it is my duty as a Virginian to fight against that. I think any conservative here that doesn’t feel the same way should stop posting today and vote for Obama.

    All I can say is, Go Corey! Contrasting him to Mr. Colgan, I see a man who isn’t afraid to use his power to fight for his beliefs. Unlike other counties, which are willing to shrug their shoulders and call this a federal issue, our leadership has stood strong in the face of criticism that would make anyone else whither. Call him a carpetbagger if you wish, but at least Mr. Stewart is keeping his word.

    If the media would make at least the slightest effort to correctly report what is happening in the county then nobody would be laughing. Every morning when I turn on WMAL there is a story about some negative aspect of the resolution. The only problem is the story is usually slanted or misleading. Anyway, I don’t give a rip about what persons in other areas think about me or my county. My own eyes see positive changes happening; we need more action not less. Anyone who blames the foreclosures on this resolution are in a state of denial.

    I think the only reason she may have voted for a Republican Supervisor is to keep Dominion Power from putting a power pole in her back yard.     Actually, Anchor Baby, there ARE laws that are being violated by those “hanging out at a local 7-11 or a Home Depot without identification and refusing to show them to a peace officer.” There are loitering laws, trespassing laws (should the owner/manager choose to complain), nuisance laws, and a variety of other laws that many (not all) of those loiters have been observed violating (public drunkenness, public lewdness to name two…and I imagine that there must be some law against urinating and defecating in public). I assure you (and you know very well that it’s true), had these people doing this been young teens or all Caucasian Americans, they would at the very least have been broken up by the police LONG ago…and if they showed up again arrested, or at the least cited. Their identification would have most certainly been demanded, legally.

    It’s obvious to me that you are a Libertarian, Anchor Baby. I know a few Libertarians…I knew many more in my youth. I recognize how passionately you feel about the issue of personal and individual rights, and in many ways I share that. However, pure Libertarianism is impracticable in a civilized society with laws, even if only the rights of others are being protected by those laws…anything less is anarchy.

    I think people are getting Alanna and Elena mixed up although neither were members of the Republican committee. Elena is an avowed democrat, but not a member of the local committee. She supported both John Stirrup and Corey Stewart due to their positions on land use. She held fundraisers for Stewart only to voice her shame over doing so publically at the BOCS meetings.

    Alanna doesn’t seem to think like a Republican. She may have voted for John Stirrup and George Bush, but her thinking definitely lines up more with democrats. She may stay at home but her opinions on health care, education, etc. are far more liberal than the typical Republican. This may be a case of “I’m a registered Republican BUT” syndrome.

    What’s all the hype about Alanna and Elena for? The Repuke party is finished. They needed an issue to distract everyone from the quagmire or iraq and the slow asphyxiation of the falling dollar so they decided to attack the dignity and honor of the fastest growing minority in the US.     I was very impressed with the foreclosure report, the suggestions about assisting with house buying for first responders, and with Michelle Casicato’s report on the priorities of neighborhood services.

    It really showed me that we have a fine bunch of people working for Prince William County.

    I was particularly impressed with Maureen Caddigan’s kind words spoken about death of Mr. Crone. She truly showed what a classy lady she really is. Mr. Crone was known far and wide for giving the BOCS a fit when he felt they deserved it.

    I did not watch too long this evening. By the time they came back into session, American Idol came on.

    The disgust with the growing illegal alien problem finds support on BOTH sides of the aisle. Many Dems were voted in because they campaigned on an anti-illegal platform. They are now in a tight spot because they co-sponsored SAVE but refuse to sign the discharge petition and are under pressure from their constituents and Pelosi on opposite sides of the argument.

    You are right. Old style party politics is dead. Greg is a leader of the new frontier. Grass roots advocacy is where it’s at — a return to basics, and solving problems at a local level. People have lost their faith in big government to act in their interests, and are taking matters into their own hands.

    Hazelton was the first salvo, but the Rule of Law resolution is the first victory in a long battle. Oklahoma and others followed, more to come.

    This is just the beginning. It is far from over.

    The people have spoken and this is democracy’s rebirth. Enough is enough.

    I called Suffolk County, NY legislators to congratulate them on the passing of HR1105 — Contractor verification — as their first step towards controlling the out of control illegal alien problem on Long Island. My inlaws & extended family still live in Suffolk Cty, and they are beyond fed up.

    The inlaws and legislators both told me PWC is an inspiration to them.

    Not a laughing stock. An inspiration, that the will of the people can make a difference. People are tired of “politics as usual” and want results.

    Communities are being reclaimed, one step at a time.

    The county can go forward when it no longer has to defend itself against attacks to the resolution by those parties that have a stake in making sure it fails. Don’t blame the leadership for that. Instead, thank them for standing strong and not cowering under the pressure being brought to bear. As I wrote earlier, thank you Corey Stewart for not being the weak politician in the mold of Chuck Colgan. Thank you for being honest, and for putting your reputation on the line in order to fulfil the promises you made to constituents.
