A Morning With The Day Laborers

I had the distinct pleasure today of spending a little time this morning at the day laborer site at the 7-11 on Coverstone Drive, documenting all those folks who seem so eager to violate state and federal laws that prohibit the employment of illegal aliens and unlicensed contractors.  It’s kind of fascinating to watch what happens at one of these sites, although I imagine the presence of myself and a few others might have altered just a few people’s behavior.  Even so, it’s pretty amazing how many folks are so dedicated to recklessly breaking the law.

We arrived at about 8:00AM, finding a little more than thirty day laborers present.  We took pictures of all the folks hiring day laborers so we could provide evidence to state and federal law enforcement agencies, which we hope will assist them in investigating the numerous felony violations we believe were committed.  Although there were some questions at first by folks unaccustomed to having persons of a different ethnic background hang out in front of a 7-11 with cameras, everyone seemed to behave themselves for the most part.  Some people driving by were downright friendly, giving us a thumbs-up sign and waving.  We stayed until 10:00 AM, documenting about six cases of day laborers getting into people’s cars or trucks, chatting with a few 7-11 customers, and watching the open borders lobby show up like someone had pulled a fire alarm.

A little while after we got there, we went into the 7-11 to get some coffee and snacks, and were surprised to see some day laborers buying twelve packs of beer at 8:00AM.  I guess they weren’t all that interested in getting hired immediately, since they went out behind the 7-11 and decided to have whatever celebration was appropriate to the occasion there.  They may have come back out to join the others later on, but I didn’t notice.

For some reason quite a few people drove up to the spot and passed by without picking up any day laborers or stopping by the 7-11, which was strange.  Now why would someone take this minor detour off of Coverstone Drive, carefully note who was there, and then drive off?  Was it perhaps someone who had intended to do something unlawful, and noticing people dressed in Help Save Manassas t-shirts got a sudden pang of conscience and decided to pass up hiring these highly skilled and valuable workers?  It’s hard to tell.  The few that did hire day laborers this morning didn’t seem to display the usual excitement that comes when someone’s picture is being taken, and tried to be awfully sneaky.  Perhaps they felt they should have combed their hair or something, and just weren’t presentable.

Within about a half hour of our arrival, Mr. Gaudencio Fernandez showed up, taking time away from filing his demolition permit application that he claims he’s simply too busy to file, and was really the only hostile person there.  He confronted the remote video crew that was documenting our behavior in case the illegal alien advocates start making bizarre and untruthful claims about what happened.  About thirty minutes after that, Ricardo Juarez and Nancy Lyall of Mexicans Without Borders drove up, had a conference with the day laborers, handed out business cards, and at one point attempted to shield a minivan picking up day laborers from being photographed and spoke with the driver.  I’m not sure if this constitutes conspiracy or aiding and abetting a felony, but we’ll let law enforcement sort that one out.  Finally, Eric Byler arrived, set up his video equipment on the sidewalk and did a good job of discouraging any unlawful activity for a while before removing himself to film from behind some bushes.  I wouldn’t have figured him to be the type that would be interested in documenting the unlawful employment of suspected illegal aliens, but he ended up being very noticeable and probably helped a bit.  How nice of him.

We had an opportunity to pick up some of the trash that was all over the place, and when Byler showed up the day laborers started pitching in to help as well.  From the looks of the place when we arrived, I don’t think a litter crew had been by the place in weeks, but when we left most of the empty beer bottles and other large pieces of litter had been cleaned up.  We left the site better than we found it, which is something to feel good about.

At 10:00 we packed up and left to spend this beautiful Saturday with our families.  There were perhaps a dozen day laborers left who hadn’t walked away or gotten picked up, along with Eric Byler and Mr. Fernandez who we waved to on our way out.  I think everyone had a good time, and this certainly was the place to be this morning, although Mr. Fernandez seemed to be bothered by something.  Hopefully his mood will improve with the bright clear skies and nice temperatures today.

I’m looking forward to doing this again real soon.

    Great job Greg and all the HSM people. You all are certainly honest Americans and we all appreciate that.

    You can bet these loiters will be there all day and Sunday and Monday. No one will come to pick them up for work,I am sure.

    Wonder if the ones who pick up these guys,think of the consequences of some one who’s drunk or half drunk and they then goof and cause an accident at work.

    The sooner we can bring out who the businesses are that hire these people,the sooner we save our professional workers and keep them from going out of business.

    Yes, they get drunk. When they get drunk they can do just about anything including jumping a car.

    The police should arrest them for being drunk in public. That should be easy to enforce.

    Do you think the police would stand by and let it happen?

    This story just shows what a difference the day laborer center in Herndon made! Herndon 7-11 was mobbed and picker-uppers were mobbed before the Center was established. George Taplin and his minute men were hanging out with cameras, enjoying the early morning snapping and filming to their hears content. Writing down registration numbers, putting photos in some kind of register …

    Once the Center was in use, there were no more loiterers at 7-11 or hardly any other place. The workers were registered, they were sober, they were not cheated out of their pay, they were given lunches at the workplace.
    Center is closed, men are back on the streets.

    Greg, why don’t you ask Taplin to advise you. He’s the specialist. (BTW, what happened to Taplin’s Troops?) What a wonderful way to spend a beautiful Saturday morning - and you want to do it again! Hope you take your children with you so they can witness your worthwhile voluunteerism.

    Seriously, you might be surprised by the number of “immigrants” who show up in court for anything from drunk in public to child molestation. They are very often painters, construction/home improvement laborers. You don’t know who you are really allowing into your home. Time to hire family, friends and neighbors that you know.

    We were not harassing “innocent hardworkers”. We were photographing and videotaping those who unlawfully hire these “innocent hardworkers”. If one of these “innocent hardworkers” managed to get themselves within the shot, it was simply because there was no other way to get a shot at the vehicle and/or the vehicle’s driver.

    We already know that the PWCPD could care less about suspected illegal aliens unlawfully loitering, trespassing, taking a dump on the side of a building, assaulting people, or the other myriad violations of the law they regularly commit. There’s demonstrably no point in photographing day laborers. Instead, we’re documenting who is unlawfully hiring them.

    I’ve heard the folks who claim they’re really against illegal immigration but want to be “humane” to illegal aliens by ignoring their violation of the law, but want people to focus on employers instead. That’s what’s happening here. We’re documenting folks of all racial and/or ethnic background who we believe may be committing a felony violation of the law and referring that to the appropriate law enforcement agencies.

    I’m sure this will make those folks very happy. Hopefully we can put some criminals in jail that aren’t representative of a specific ethnic group. Not that I expect anyone to stop smearing me as a racist, but one can still hope they give up this ridiculous race-baiting at some point.

    Let’s see what would happen if the shoe were on the other foot.

    If you had to sleep under a bush last night in a foreign country that you had traveled to with the hope that you could make a few dollars for yourself and to support your wife and kids, then you encountered a couple of wise-asses with cameras trying to get between you and a day’s pay, how would you react. Oh, if you still got a job anyway, you might do nothing. However, as your hunger grew, and your opportunities kept getting scared off, you might take some sort of action against the wise-asses who were costing you jobs and the accompanying pay.

    I think that what you are doing, however well intentioned, is putting you and your families at great risk. You don’t know how hungry and desperate that some of these folks can be. Sure, some of these migrants can be just as nice as can be, but I know how workers can get when they see someone interfering with their chance to earn. Take a look back at our own country during times of famine and labor strife. It is not a racial issue. When workers are hungry, tired and desperate, they do dangerous and irrational acts, including visiting violence on anyone seen as getting between the workers and their next meal.

    Perhaps you and your group could turn your energy into a positive direction by helping these illegal immigrants to become legal, or at least to help them learn language and civic skills so that they can function in harmony with the local community until they can gain legal status, or return to their native country. Setting up an ESL class and a Civics class is not very difficult and for ESL, you don’t even need to speak Spanish, or any other language. You use pictures and skits to demonstrate language skills.

    I don’t advocate that you turn a blind eye to those who hire illegals, or the illegals themselves. I just encourage that a more positive, productive approach is used until our nation achieves the political will to actually change our current open borders policy. The workers are only responding to the opportunity. Don’t punish them for wanting a better life. Punish the employers who want to avoid paying Americans’ the pay to do these jobs and punish the politicians who are abetting the multinational corporations instead of serving the People of the United States.

    you are incorrect, trust me I speak truly. you cannot “knowingly” hire an illegal alien. you can hire a “day laborer”. the proper way to do this is to file basically 1099 the person you hire for each job. according to the IRS a daylaborer is not synonymous with illegal alien but precautions must be taken by the prospective employer BEFORE hiring.

    According to the law, you are not supposed to pay anyone without first getting their full name, address and Social Security Number for the 1099 form so you can report the amount you paid, if it is $600 or more in a calendar year. If the laborers are not citizens, they are supposed to furnish you other additional documentation thus you cannot hire them unless they can furnish acceptable proof. If you have done your due diligence then you can hire them and you’ll be in the clear, otherwise you are on the wrong side of the law.

    You’re right, El Guapo…which brings up an excellent point because it is only legal to hire a LEGAL immigrant or citizen day laborer. That makes it more than appropriate, but actually a legal obligation to demand documentation from any of these people before they are hired…it’s the LAW!

    By the way, Josh…as long as they are here legally, there is a category of employment called “casual labor” which does not necessitate filing a 1099, as long as the labor is under a certain number of work hours. Once upon a time this was 35 hours…I’m sure that’s been considerably reduced, but it still exists.

    The injustice has been committed against immigrants and their families. Immigration law is about as reasonable as prohibition law back in the 1920s.

    as far as I know right now it’s casual labor if the dollar amount per individual is under 600.00 per year anything over that would necessitate filing a 1099 would be employment. this is to get away from filing a 1099 for a kid mowing your lawn every so often. this was/is an IRS regulation. I would run down the current IRS regulations as the filing of the 1099 would be covered there. Everything else is federal and I wouldnt be surprised if there is an hourly limit. The whole “hourly limit” thing sounds like IRS code but I’ve never seen it to be honest. The 600.00 per year test I’ve seen though.

    Having at one time managed a masonry construction company, Josh, I did have some experience with “casual labor,” and there was a restriction on hours as well as a ceiling amount. If I recall correctly, the hours restriction was 35 hours/week and the dollar amount could have been as low as $600…but keep in mind, wages were a LOT lower in the Middle Ages. ;-)

    AWCheney - totally agree about any legal immigrant who came here the right way not liking people who want to circumvent that law. My wife is a legal immigrant and it was a long process for us - and both of us resent the fact that others think they can come here illegally and then be granted amnesty. Anyway, most legal immigrants are not going to look favorably on the illegals being granted amnesty, or the fact they’re in this country in the first place.

    I have 2 dear friends who earned their citizenship about 10 or so years ago. Both (husband and wife) were born in Mexico and came to this country legally. They attempted to help the Hispanics in their neighborhood and church and tried to get them to assemilate, learn English etc. They received total refusal for their efforts. They said they did not desire to assemilare and preferred to remain amoung their own group of “Immigrants,” some of which were most likely ILLEGALS. That is the main problem with these people. They want to remain in their own “ghetto.”

    I think the USA needs a 10 year “time out” on immigration of all kinds. Face it, the government can’t handle the paper work and the country is over whelmed.

    A 10 year time out would give the country time to sort out the mess that has been created by not enforcing current immigration laws.

    Patty is absolutely correct - I was with a friend photographing MS 13 graffiti in a property behing the Coverstone 7-11. A day laborer saw me through the trees and ran up the hill and to the fence yelling f-in ___ and was coming for me and the lady who was with me. Some of the day laborers are agressive, abusive, and dangerous. In Woodbridge, they actually approached a woman’s car from all sides, rocked the vehicle, and then one man whippped out his manhood and showed it to her.

    Unless you have been in the situation, which I have, and which Patty has, you have no idea how threatening these people can be.

We stayed in the public right of way areas, we patronized 7-11, we minded our own business, and we were visible wearing our HSM t-shirts. We didn’t confront anyone.     I can speak from experience that the day laborers are aggressive and abusive. I took pictures of these lazy bastards as they sat around the 7-11 at 1230, drinking beer and leering at the women. They did come to my car, started rocking it and one wonderful gentlemen exposed himself to me. When I went to the County and spoke, Chief Deane couldn’t have cared less. In fact, he could barely keep his butt in his seat and spent more time OUTSIDE of the meeting hanging out with his cronies…he’s a waste of space.

    I took a look over the other site awhile back and saw some disturbing posts. some of the posts advocated finding out information about BVBL posters (more often than not Greg) and contacting his/her place of employment, military commanding officer, etc. I think one post pointed out the location of schools of various personae’s children that post/view here. This seems a bit over the top to me, not sure about everyone else but harrassing employers and people at their place of business seem to be ludicrous to me, no other way to look at it. putting the location of the school where a person’s chilren attend attains a whole new low even for the bvbl crowd. the simple fact that people went out of their way to attain this information speaks volumes. I think they may have removed those posts, but I did see them at one point in time.

    Shortly after the center opened, a letter appeared in the WaPo, noting that day laborers were still showing up all over Herndon though in smaller numbers at each area. I contacted a different person that I knew of in Herndon and we chatted about the situation. This person said that:
    1) As soon as the center came into being, the crowd at 7-11 sort of split up and started showing up at the center AND at various places in Herndon, but with smaller aggregates.
    2) Many employers didn’t want to use the center. In part it was LIKELY because they didn’t have licenses, etc. We are not talking about Joe Citizen who is looking for somebody to paint his Momma’s porch. We are talking about contractors who had not bothered to go though the normal procedures that are required to operate as a business.
    3) After the initial daily lottery occurred in which the workers received their numbers, many of the ones who received higher numbers left the center, knowing that if they were 30 and 25 was the likely number that would get jobs that day, they wouldn’t get a job that day. They went to the informal pick-up sites and took their chances there.
    In short, the center didn’t halt soliciting on street corners at all. It just dispersed workers thoughout the Herndon area, including the center, which didn’t come close - according to WaPo - to covering all interested workers.

    Greg L, you are, of course, correct about a job center attracting still more illegal alien workers to an area. This was, no doubt, why RESTON Interfaith placed the job center in Herndon, not Reston, as I pointed out in an earlier post on your blog.

    Herndon was stuck not only with the job site itself but also with the day-to-day costs of the workers it attracted and often their families. These costs, quite naturally, were both financial and social and very expensive in both cases. The Herndon Day Laborer Job Center was about as good an example of the unscrupulous business interests, mostly outside of an area who want cheap labor , cooperating with do-gooders, also outside of the area and so not affected by the results of their misguided endeavors, to shift the costs totally onto another community. Fortunately, this particular community fought back - and won.

    Only a buffoon would believe this hogwash. They come for jobs, not because there are a few benches with a tent and a ticket number machine. There are lotsa jobs and we can all be grateful that we have lotsa immigrants to do those jobs and keep the economy going.

    The day laborer center was a great idea and it should have been replicated in PWC. Now, thanks to gremlin greg, our county has tonsa of foreclosed homes being bought up by renters, miles of grassy lawns to mow at a multimillion price tag (whos gonna mow the lawns? hahaha), and we have an international reputation for degrading and humiliating anyone who’s not white.     AWCheney: Agree with you about actually expediting legal immigration applications. The current system is really bogged down and a mess (it is largely paper driven and not terribly computerized). Last year when amnesty was going through Congress, I had no idea what would happen if they suddenly had to handle 12 million (an estimate I heard) amnesty applications on top of the current load. Having just been through the system with my wife, from what I observed the amnesty stuff would have caused the whole system to collapse. They routinely lose stuff, misfile things, etc. as an application works its way through the process - it happened to my wife - they lost her medical records and it caused a reset of the whole process, and lots of extra money and wasted time. They are basically still working with 80’s technology believe it or not! In fact fees recently doubled approximately, supposedly to speed up applications, but from what I’ve heard that hasn’t happened - partially because that caused a huge influx of applications right before the deadline when the fees doubled (last August)!

    The same thing happens at the Social Security Administration, as I found out when my mother tried to collect my father’s social security. They “lost” her paperwork. She asked me to call a friend of mine who happened to be our Congressman at the time and she got it, along with back payments, within two weeks…they “found” her paperwork on someone’s desk.     AWCheney: We also turned to Congressman Wolf’s office for help. In fact, they have someone dedicated to helping untangle immigration application snafus. They did tell me they see this all the time with things routinely getting lost. They did expedite our “re-application” last July - which was during the onslaught of applications due to the imminent higher fees. The original medical exam records (wihch were sealed and they wouldn’t accept copies of) never did turn up - so not only did we have to pay the application fee again, but get the medical exam and vaccines all over again (they won’t accept vaccines more than a year old at the date of application!). A very large expense, thanks to their incompetence, as the medical exam/vaccines are not cheap, nor is the application fee (and it is even more expensive now after the fee increases last August).

    Interesting article in today’s Washpost Metro section titled : “Shuttered Homes, Thriving Wildlife”. It states that there are about 7000 (seven thousand) empty houses in Prince William county.

    Non-Anon - Where do the people live who want to know what it looks where the fat broads live? (Who are the fat broads anyway?)

    My question re Stewart was to find out whether he lives in an area with empty houses and jungle yards; in other words, affected by his and his Boards decision. IF he does, it would be interesting to know what he thinks about the situation.

    Honestly, if I didn’t know the jobs were mostly construction related, this sounds like a pickup point for prostitutes.

    People standing on a street corner, waiting for sneaky people to drive by, negotiate a price for an illegal act and driving off together.

    The police have set up vice squads to stop prostitutes, why isn’t ICE dedicating two or three officers to driving around picking up illegals at very well known pickup points? It would be low cost enforcement and would scare many illegals off from hanging around waiting to turn a “trick”, so to speak. The effect of knowing the next “employer” could be an ICE agent may be enough to send another few thousand back home.

    Sorry, that is a constructive, effective and low-cost method of solving a probem, our governments would never let that happen.

    I totally agree with ICE coming by and posing as a contractor and grabbing a truck load of them and checking their status, or even asking their status before they get into the vehicle.

    The Coverstone 7-11 has a long history behind it, cutting to the chase the way I understand it is that the police arrested a bunch of the day laborers for loitering and the 7-11 folks didn’t bother to show up for court so the police are not wasting their time. Greg went down there a few months ago, maybe 6 or 7 months ago and was treated rudely and then a PWC cop pulled him over stating that he had a complaint that Greg was harassing people that are only here to work hard and not commit crimes like fraud and ID theft etc, etc. So that Day Laborer Center has a lot of history to it.

    You seem to be mostly concerned about the fact that these people are breaking the law by hiring illegal immigrants.

    If illegal immigrants became legal through more work visas or whatever process that makes it easier for people to cross the border legally, then what would your feelings be about people hiring day laborers and a large hispanic community in certain counties?

    Olivia—I’m not sure why you think it SHOULD be easier for immigrants to obtain work visas or cross the border legally. Immigrants from Africa, Vietnam, Korea, Russia, Poland, etc. already have it harder than Central American immigrants, because they can’t just walk across the border, and their government aren’t issuing official publications about how to enter the U.S. illegally and set up shop without being shot.

    Show me 30 guys of any race, religion or immigration status standing in front of a 7-11, drinking beer at 8am, urinating in public and evading taxes on their income, and I’ll do my best to get them all arrested, too. OH, THAT’S RIGHT—-I wouldn’t HAVE to do that, because the cops wouldn’t hesitate to arrest them if they were black or white. Nobody is raising a political ruckus to protect them.

    Krutis—you were successfully making a point about the day laborer center unti you pointed out that at the DLC, we were giving them lunch. Huh. When I was laid off after 9/11 and went to the VEC employment center to look for work, nobody gave ME lunch! My employers and I all paid into the unemployment program over the course of more than 15 years so that I could draw about 1/3 of the salary I had been making each week—not to mention that my father had paid into the program for about 48 years without ever drawing unemployment. And come April 15, I had to pay taxes on my income.

    All the “jobs Americans won’t do” folks should consider this: I worked in a McDonalds when I was young, and always thought I would make it a requirement for my children because, under the old training program, a job at McDonalds taught a lot of important business skills that could be used later on. That is no longer the case. I have stopped patronizing McDonalds because they have stopped caring about the customers (I even break down and say “no huevos” because I have an egg allergy, but they don’t care.) and because I have observed male workers sexually harassing the female workers. At the McDonalds close to my officer, virtually all the workers are latino and none of them seem to mind. My daughter would mind. I would mind if the men addressed my daughter the way they address the female workers.

    It’s not that I don’t want my daughter to work at McDonalds or that she wouldn’t do it. It’s that I don’t want my daughter to be subjected to leering and inappropriate comments at the tender age of 16, and I don’t want her to learn that a job half done is good enough.

    Uncontrolled immigration has brought to this country a general lowering of standards that threatens the fiber of our country. Yes, both legal and illegal immigrants contribute to this dynamic, but it is the ILLEGAL immigration that is uncontrolled, and the LEGAL immigrants, by virtue of doing it right, have demonstrated that they value our country and respect its laws.
