You really can’t blame a defense attorney for doing his best to vigorously defend his clients, but this is patently ridiculous. Two of the three defendants accused of murdering Omar Florencio-Vazquez appeared in court recently, arguing that the trial should be moved from Prince William County because of local “anti-immigrant sentiment”. Instead of trying three illegal aliens for murder, the defense wants to try the residents of this county for not properly appreciating the contributions of criminal illegal aliens to our society.
Sebastian Cortes-Hernandez, Jose Antonio Ontiveros and Santos Ontiveros were indicted on charges of first degree murder last August. Attempting to avoid a confrontation last May with about a dozen men who had assaulted him previously, the victim and his brother attempted to leave the shopping center in Georgetown South when the three accused left the shopping center and started following Florencio-Vazquez. The group punched Florencio-Vazquez, threatened him with a knife, and finally Cortez-Hernandez pulled out a pistol and pumped four bullets into Florencio-Vazquez. All three of the accused are illegal aliens, and Cortez-Hernandez had been deported to Mexico in 2003.
Now that the pre-trial preliminaries are under way, the attorneys for Santos Ontiveros and Sebastian Cortes-Hernandez say that an “anti-immigrant” sentiment prevents a fair trial from being conducted for these two. In order for this argument to have any merit, you’d think the defense attorney would want to prove that these two murderous thugs were actually immigrants, rather than the criminally-disposed illegal alien invaders they are. I guess we’re supposed to take it on faith that anyone who is a previously deported illegal alien is somehow an immigrant, but in court “faith” isn’t supposed to be a requirement. They have to prove stuff there, right?
The distinction is one that the illegal alien lobby certainly seems interested in glossing over. Conflating illegal aliens coming just to take what they can, regardless of the consequences imposed on anyone else, with immigrants who are making a permanent investment in our nation and our society is a wicked assault on immigrants. It’s not unlike conflating all men with rapists, because they might share a characteristic or two. The distinction that the defense, and apparently the illegal alien lobby in general, is trying to paper over is one of behavior. It is behavior that separates the immigrant who is welcomed from the illegal alien who is rightly decried, just as behavior is the difference between men who abuse women, and those who don’t.
When our physical characteristics become more important than our behavior, the identity politics that result are terribly destructive to our society, resulting in a sense of societal tribalism that groups us into endlessly warring factions seeking success only through subjugating other tribes. It is the society of the Hutu and Tutsi, the Croat and the Serb, and the Jew and the Gentile. We’ve seen the results, and they’re utterly tragic and despicable. When identity is valued over behavior, the end result in too many cases becomes genocide.
An immigrant is an immigrant not because of what he looks like, what part of the world he comes from, or what language he speaks. What makes an immigrant different from everyone and everything else is the goal they seek and the behavior they exhibit which furthers that goal. When that classification is debased into meaning “non-white non-citizen”, we will start indoctrinating true immigrants into our society from the very beginning with the notion that ethnic and race-based identity politics is what matters, not what actions they take to better themselves, our community and our nation.
It might make for a creative defense argument, but it is absolutely irresponsible.
