Breaking…

Gaudencio Fernandez, the “gentleman” who had erected a billboard on Prince William Street across from the train station is at this hour erecting yet another monstrosity.  Early reports indicate that he is displeased with the decision of the Manassas City Police Department to participate in the Section 287(g) Program some months ago, and decided the appropriate response is to play another game of legal “chicken” with the city over another act of civic vandalism.

I doubt the city will be as lenient with him this time as it was the last time.  Fernandez apparently thinks the resolve of the city is weak.  Now is a wonderful opportunity for the city to conclusively demonstrate it is not.

Stay tuned for updates.

Will the new billboard be as offensive as the last?  We’ll see.

UPDATE: There is a Quarterly Town Hall meeting Monday night at Baldwin Elementary School at 7:00PM, which is a perfect opportunity for citizens to demand that their elected officials respond quickly to this outrage. Baldwin is at 9705 Main St
Manassas, VA 20110.

UPDATE 2: As of Monday afternoon, a message has been painted on the sign calling on President Obama to remove all border controls between the United States and Mexico.  This is just silly.

    This is a very good letter to the editor. This woman made some good points. For some reason, people have difficulty structuring their arguments when arguing against supporting the currently proposed immigration revisions. This lady made the argument pretty simple.

    Newspapers simply won’t publish letters to the editor which they either deem politically incorrect (read below) or which do not agree with the philosophy they’re pushing on the public. This woman wrote a great letter to the editor that should have been published. With your help it will get published via cyberspace!

    My wife, Rosemary, wrote a wonderful letter to the editor of the OC Register which, of course, was not printed. So, I decided to ‘print’ it myself by sending it out on the Internet. Pass it along if you feel so inclined. Written in response to a series of letters to the editor in the Orange County Register:

    Dear Editor:
    So many letter writers have based their arguments on how this land is made up of immigrants. Ernie Lujan for one, suggests we should tear down the Statue of Liberty because the people now in question aren’t being treated the same as those who passed through Ellis Island and other ports of entry.

    Maybe we should turn to our history books and point out to people like Mr. Lujan why today’s American is not willing to accept this new kind of immigrant any longer. Back in 1900 when there was a rush from all areas of Europe to come to the United States, people had to get off a ship and stand in a long line in New York and be documented. Some would even get down on their hands and knees and kiss the ground. They made a pledge to uphold the laws and support their new country in good and bad times. They made learning English a primary rule in their new American households and some even changed their names to blend in with their new home.

    They had waved good bye to their birth place to give their children a new life and did everything in their power to help their children a ssimilate into one culture. Nothing was handed to them. No free lunches, no welfare, no labor laws to protect them. All they had were the skills and craftsmanship they had brought with them to trade for a future of prosperity.

    Most of their children came of age when World War II broke out. My father fought along side men whose parents had come straight over from Germany , Italy , France and Japan; None of these 1st generation Americans ever gave any thought about what country their parents had come from. They were Americans fighting Hitler, Mussolini and the Emperor of Japan They were defending the United States of America as one people.

    When we liberated France , no one in those villages were looking for the French American or the German American or the Irish American. The people of France saw only Americans. And we carried one flag that represented one country. Not one of those immigrant sons would have thought about picking up another
    country’s flag and waving it to represent who they were. It would have been a disgrace to their parents who had sacrificed so much to be here. These immigrants truly knew what it meant to be an American. They stirred the melting pot into one red, white and blue bowl.

    And here we are in 2008 with a new kind of immigrant who wants the same rights and privileges only they want to achieve it by playing with a different set of rules; one that includes the entitlement card and a guarantee of being faithful to their mother country. I’m sorry, that’s not what being an American is all about. I believe that the immigrants who landed on Ellis Island in the early 1900’s deserve better than that for all the toil, hard work and sacrifice in raising future generations to create a land that has become a beacon for those legally searching for a better life. I think they would be appalled that they are being used as an example by those waving foreign country flags.

    And for that suggestion about taking down the Statue of Liberty , it happens to mean a lot to the citizens who are voting on the immigration bill. I wouldn’t start talking about dismantling the United States just yet.

    The question here will be determined by the building official and that question is “does the billboard being erected require a permit.” if the answer is no then the City will have to rest any enforcement action on the opinion of the zoning administrator and the City Attorney and that will be “does the owner of a vacant residential property have the unquestionable right to place political messages on his property as you and me on our property which we live on a daily basis.” This will turn into a land use issue if the billboard does not require a permit. My first guess would be if no permit is required and the owner does not hold rallys and other events on the property which was one of the main issues the last time, then the City will take no official stance or enforcement action. A lot of questions on this issue. Will you be posting a picture of the new billboard?

    I have no idea why the Register didn’t publish it. It could be because of its errors, it could be because it is extremely long for a letter to the editor, or it could be because they published the same opinion in other letters that Mr. LaBonte declines to mention. But happily for us you have retrieved this chestnut. Yay!

    I rode by the new structure this evening and had a thought. Perhaps this new attempt at harassing the community should just be IGNORED–no blogging, no letters, no outrage whatsoever. It would be the last thing Ferndandez would expect, and not at all what he wants.

    Fernandez wasn’t fined for the last sign because the courts gave him the option to take it down before that happened.

    It won’t work, Emma…that’s what the MSM would love to see happen. That way they would have no opposition to their own warped take on the issue.

    Now correct me if I’m wrong…wasn’t Fernandez turned down for a permit to put another sign up after he finally the battle on the last one? Now, either the City screwed up and went ahead and issued that permit…or they’ve got a REALLY good foundation for throwing the book at him before it becomes a major issue again.

    He already got away with it, Love the USA. Despite all the protest, the city–and the court–gave him consideration that the rest of us would never get. Thanks to that special treatment, he’s at it again, and no doubt he’ll be allowed to push the City around long enough to make his point and get everyone all riled up. I don’t have a lot of faith that our City Council will grow a spine anytime soon and actually enforce the zoning laws. My sense is that he’s goading the City into an expensive lawsuit.

    What’s the alternative? A class action suit by residents of the City claiming unequal protection under the law? Or perhaps a series of similar structures with opposing messages on private property throughout the City? More thoughts.

    I’m just imagining that, like a certain newscaster, Fernandez gets a tingle down his leg from all the excitement and attention, and MWB and the ACLU are salivating.

    Emma, do you have evidence that a similar political sign put up by someone else would not receive the same tentative reaction from the city? The ACLU takes clients on free speech issues across the political spectrum, Skokie being only the most famous example.

    The solution, Emma, is for the City to treat Fernandez just as they would any other citizen…go straight to court, have him charged under the law, and then prosecute him to the full extent of it. He has shown a flagrant disregard for the law and, I believe, repeat offenders are supposed to get a bit more than a slap on the fingers…at least ordinary people do.

    Love the USA, only if required by the Virginia Uniform Statewide Building Code. You can build a shed in your yard w/out a permit as long as it is 150 square feet or less. As I remember, as long as it is less than 150 square feet and does not contain footers for support, then a building permit would not be required. I believe!

    AWCheney, if only the City would act fairly and promptly against this repeat offender, that would be the ideal solution. As I said, we’ll see if they have grown a spine since the last violation. Otherwise we will have to suffer through Fernandez flipping the bird at the community and soaking up all the attention. The new structure is significantly longer than the old one. Hard to believe the City could have granted him a permit.

    I think we should let Fernandez put up another monstrosity, with the most inflamatory speech imaginable. If the last election is ANY indication, the electorate is ignorant and apathetic as to what is at stake here. Let Fernandsz become the voice of the radical left once more. Let him defame good citizens like Hal Parrish. Let him accuse the citizenry of Manassas, the very citizens who voted in majority for Obama, of being racists. Let him keep his wall up until November of next year, and watch Jackson Miller get re-elected by a huge majority, and watch Manassas give Bob McDonnel the votes he needs to become governor. Let him reignite the passion in the citizens who once packed HSM meetings. Let him put up signs supporting Jennette Rishell again, because she will chose to look at the Obama/Warner margins, instead of the Wolf/Feder margins, and will charge once more into the breech.

    Of course there is another option too. The City could chose to expand the Museum, and seize the property under eminent domain. The SCOUS already ruled in Kelo that the City can do this.

    However, I like option 1.

    Merely the musings of a private citizen; It seems there are several issues here:

    First, did he need a permit before doing anything? Presumably so but we’ll find out. It’s hard to believe someone can construct seventy feet of anything on their property without a permit. [And if it turns out he didn’t need a permit under the present code, then big time shame on anyone in charge of making sure the code is effective. Bottom line: It was forseeable that this was going to be tested.]

    Second, can he be punished for violating a city’s stop work order which I believe the city issued yesterday?

    (a) Certainly yes if there was a valid permit requirement in the first place. (b) Maybe yes even if there was not a valid permit requirement. (In other words, even if a permit was not required, can citizens ignore improperly issued stop work orders or is the sole correct alternative to obey the order by stopping work and then challenging the order in court? It would seem to me that we cannot have citizens disregarding stop work orders simply because they believe they are not correct. Sort of like telling a police officer he cannot arrest you and walking away because you believe you are innocent.)

    Third, how about an argument that the city does not pursue other violations quite as vociferously? Well, the city does when complaints are made. Also, few other potential violations involve a massive sign in the middle of our downtown.

    Fourth, will a judge likely require him to immediately remove the sign? Well, even assuming a permit was needed, probably not. There is no clear emergency. Thus, there is no reason why a court cannot hold off and consider matter for (at least) a few weeks. [However, had time allowed — and I’m just speculating here — a judge may have been willing to enjoin him from construcing the sign. In such event, there would have been both a stop order issued by the city and an order from a judge that he would have violated.] I’m a bit surprised that a preliminary or temporary injunction was not sought from a judge even though yesterday was a Sunday. It’s typically easier to stop something from being done than it is to get something taken down. But perhaps the City Attorney thought this was not the way to go, I don’t really know.

    “We believe the laws are implemented against immigrants and are in violation of our constitutional rights,” said Fernandez, who moved to the area seven years ago. “We believe we have no rights in Prince William and Manassas because our voice is being ignored.”

    The sign is on the last-standing wall of a former house. When the sign was erected, Manassas City Manager Lawrence D. Hughes said that the owner was not breaking any codes and that it was a matter of free speech.

    It was when Fernandez “fortified” the sign without a building permit, Hughes said, that it no longer complied with city regulations. Hughes said Fernandez also needs a special-use permit because rallies and other small events have occurred on the property in recent months.

    Fernandez said he reinforced the structure in October but did not enlarge it. He said he is submitting applications for building and special-use permits for a new sign that will be 200 feet long and 14 feet tall.

    Residents asked council members Monday why they haven’t taken action on something that violates city code.

    “Caution, that’s the answer,” Hughes said in an interview after the meeting. “We need to do this right.”

    The only response during the meeting came from Manassas Mayor Douglas S. Waldron (R): “I’d love to see the sign down because my name is on there. My term ends June 30, and I hope it will be down by then.”

    Hughes said a letter was sent to Fernandez, but nothing has followed because the city is studying free speech and code violations. He said the city has been sued by the District-based Equal Rights Center and does not want to face another legal fight.

    For Fernandez to legally follow through with his plan for a 200-foot sign, Manassas Director of Community Development Elizabeth Via said, the building permit would need to be approved by the zoning department while the special-use request must go through City Council.

    Fernandez said he is worried his requests will be denied. And, if they are, he will seek legal advice.

    “What we believe is not right is if they don’t approve it, and we won’t be able to do it. We believe this is our constitutional right,” Fernandez said. “If they deny, we will look for legal action to make sure free speech is not denied to my community.”

    I believe this answers some of the questions. Fernandez can’t do it without City approval and he has not received that approval.

    It is a logical conclusion that Fernandez does not respect the laws of the City of Manassas and believes he is entitled to do as he wishes.

    This is proof positive that he has no respect for the rule of law.

    Keith was just interviewing Gaudencio Fernandez, owner of the property at 9500 Liberty Street. It turns out that the sign is going to be a message to Barack Obama regarding our country’s southern border. It’s going to ask Obama to “…eliminate the borders that divide and conquer people of color.“ Fernandez built the wall on a slant not to get around any zoning regulation but because there is no footer. I had no idea what that was when Keith told me, but basically a footer helps keep a structure stable. Fernandez said the structure is temporary. “We are planning to remove this in no more than two months,“ he said. Also, Fernandez said people should be on the property tonight putting the message on the sign. Stay tuned for more.

    UPDATE: A reporter just returned from his lunch break and told us that people are over at the property painting the sign. It is 1:49 p.m.

    UPDATE: Keith just returned from the scene. While out there, he received a call from Manassas Community Development Director Liz Via. She said that a Stop Work order was issued Sunday. Fernandez ignored it. He says that his attorney told him he is in the right. He is going to keep working. Fernandez has already received two violations in connection with his work on the newest sign.

    The problem with Mr. F’s attorneys legal advice to him that he doesn’t need a permit because it doesn’t have a foundation is the Virginia Uniform Statewide Building Code REQUIRES some type of a footer/tiedown for ANY structure over 150 square feet. That tie down must be approved by the Building Official to ensure the structure will remail on his property during a wind storm. Kind of throws a monkey wrench in Mr. F’s theory he isn’t breaking any laws because he doesn’t need a permit. In addition, it is absolutely correct he needs a Architectural Review Board approval BEFORE constructing anything structure in the Historic District.

However I believe complaints about the way manassas handled the case came from above. This time I think it’s going to be a bit different. I think we’ll see an injunction, the fool will ignore it and then he’ll be arrested.     An interesting question is whether Mr. F has waived at least a portion of his attorney-client privilege.

    Since he has quoted what his attorney told him, I wonder if he (and his attorney) may now be questioned about that conversation. And if there is a dispute between them as to what was said, then I wonder if there may be a conflict of interest between him and his attorney.

    I guess that a potential question could also be whether his attorney told him about the code section referred to in a blog above (about whether a structure above a certain size requires a foundation) and if not, why not?

    Under these (or any) circumstances I would not wish to be either him or his attorney.

    No, we need to create a DMZ on the Southern and Northern borders and then pepper the area with anti-personnel ordinance and then place autonomic sentry guns placed 150 ft. apart. When they sense a human entering the engagement zone, they open fire.

    It doesn’t even violate the consitution since shooting a person in the DMZ *before* they get into American territory negates any consitutional defense.

    BTW, it’d be much cheaper doing it that way than building a fense that can easily be climb, broken, or dug under.

    I support this guy’s freedom of speech but he’s dead wrong and spreading his word in such a manner that actually hurts his cause.

    Wow….I can recall a time in America where people would take action on their own and make things happen. Instead, everybody nowadays just wrings their hands and says “why is he allowed to do this? It ain’t right”. You know, this guy takes matters into HIS own hands, what’s wrong with legal American citizens? Too afraid to do these things I guess.

    You ever hear someone discuss a movie who hasn’t seen the movie? Well that’s what this discussion reminds me of. My sense is the that few if any in this discussion have ever actually read the Constitution. From start, to finish. And then there are the Supreme Court cases that interpret and apply the Constitution. Read a few of them too. Not summaries of them. Read the actual decisions. Then talk.

    Yeah, I know, the liberal Supreme Court. The fact is that it has been liberal for less than twenty percent of it’s existence, and it is not liberal now. Blaming the Supremes is a cop out. Justices Roberts and Alito would most certainly agree.

    To be American means to support the Constitution. That’s why elected officials pledge to uphold the Constitution. Soldiers do too. If you don’t like the Constitution, then change it. In the meantime, abide by it. It’s the American thing to do.

    If we disregard the law (and suggest taking matters into our own hands as one blogger appears to suggest: “I can recall a time in America when people would take action on their own and make things happen” — meaning what, lynchings?), then we are no better than Mr. F.

    Frankly, I can’t stand what Mr. F is doing. It infuriates me, but I prefer the legal American route. It is the only route. Only a court has a right to kick his butt; a mob does not. American conservatives love the constitution. They do not search for loopholes through or around the constitution.

    Just Watchin — That was a great post of the unpublished letter. Reminds me much of an uncle of ours. One of his immigrant grandfathers had been in the Prussian army which crushed France in 1870. Another immigrant great-grandfather had been a Prussian cavalry officer. That uncle, a US Army lieutenant, died on the battlefield in France only 60 kilometers from the German frontier, struck twice by German rifle fire and then tank shells while trying to save a wounded comrade. The family memories of him are an old flag, several Purple Hearts, and a Silver Star. The irony of it all has never failed to strike me. This country has done a very good job over many years of creating Americans from that great wave of legal immigrants.

    Tyler Durden is absolutely correct. You may be the worst criminal/terrorist bastard on the face of the earth, but once you set foot on American soil, whether in handcuffs or not in handcuffs, you automatically get a whole lot of constitutional rights.     The city has acted promptly with respect to the sign on Liberty St. Over the last weekend, during construction of the framework, the owner was cited with a building violation. The city has petitioned the district court for a contempt citation, the owner having violated the terms of the settlement on the previous sign. A preliminary hearing is set for February 13.

    The sign does require a building permit which it does not have. It doesn’t matter if the structure is temporary or permanent, secured or unsecured. A building permit in turn, requires a finding from the Architectural Board that the sign is compatible with the downtown historic district and a finding from the Building Official that the structure conforms to the Design and Construction Standards manual. None of these steps have been taken.

    You may note the structure is not secured to the ground in a manner which would withstand the DSCM standard of 90 mph winds. If the Winter winds do blow you might want to avoid being downwind for your own safety.

    Irrespective of whatever message the sign may contain, the structure must be sound, compatible, safe and not be a billboard which is prohibited in residential districts. The city is proceeding as it would with any construction to ensure these criteria are fulfilled or that the structure is removed.

    I for one would prefer that our state and federal government would actually enforce immigration laws and support E-Verify so we wouldn’t have to continuously battle the leftist pro-illegal alien crowd. I would like the battle to be over.

    My guess is they will get him on the contempt charge.

    Because whether or not he is violating the law, part of “the law” now for him and that property is whatever he agreed to in the court settlement last year.

    If he agreed not to build a sign in that settlement, then he cannot build a sign now, even if that sign would otherwise be legal.

    And a contempt charge is a fast track to fines and jail time, because the court has already ruled on the settlement.

    Yes, you are correct. She is the former Governor of Arizona and was pushed by the Citizens and many elected officials of the State to do something about illegal aliens there.
