E-Verify In Virginia: Let’s Get It Done!

There’s a chance to ensure that all of those stimulus jobs created by federal largesse flowing to the Commonwealth aren’t going to end up paying salaries for illegal aliens in Virginia, but you’re going to have to act quickly.


Because of your previous phone calls, emails, and faxes, Delegate Bob Marshall’s budget amendment 4-6.05 requiring that “all political subdivisions and state agencies of the Commonwealth of Virginia shall use the E-Verify System operated jointly by the Department of Homeland Security and the Social Security Administration to ascertain the work status of all new employees.” passed on the House floor. Unfortunately our work isn’t quite done.

As early as next week, the “Conference Committee” will be meeting to finalize the State budget. It is essential that the language requiring the use of E-Verify remains in the final budget that is passed in order to ensure that taxpayer-funded jobs are awarded only to American citizens and legal residents.

To achieve this outcome, it is imperative that we contact the members of the “Conference Committee” and urge them to vote for the mandatory use of E-Verify by all state and local governments for every new hire.

Please note that the list of House Budget Conferee’s is accurate. However, with the exception of Senator Colgan, last year’s Senate Chair of the committee, the list of the Senate Budget Conferee’s is tentative. Based on past Senate Budget Conference Committee membership, we have been advised that the committee will likely include the other members listed below. If there are any changes, we will inform you right away.

Senator Colgan and Delegate Putney, the Chairmen of the “Conference Committee,” need to be inundated with your faxes, e-mails, and phone calls. Nevertheless, all twelve members of the committee also need to be contacted.

According to the Department of Homeland Security:

  • An employer who verifies work authorization under E-Verify has established a rebuttable presumption that it has not knowingly hired an unauthorized alien. Participation in the program does not provide a “safe harbor” from worksite enforcement, however.
  • E-Verify helps U.S. employers maintain a legal workforce.
  • E-Verify is free and is the best means available for determining employment eligibility of new hires and the validity of their Social Security numbers. It verifies a new hire’s employment eligibility, not his or her immigration status.
  • E-Verify is 99.6% accurate and 96.1% of qualified employees are cleared within seconds of a query.E-Verify is used to check workplace eligibility after, not before, an employee is hired - so it protects workers that are currently employed.

    Excellent suggestion, Greg, but let me add one thing: You are almost certain to be hit with the “argument” that the files used by E-Verify have errors. As anybody even vaguely familiar with large databases can tell you, they ALL have some errors. However, that SSA database is the one they use to collect your FICA taxes and send out your granny’s SS check. If it isn’t accurate enough to use for hiring why is it accurate enough for your taxes and Granny’s SS checks?

    The IRS database and Medicare database also have errors. Are we hearing that we have to immediately shut down collecting taxes and paying medical bills? Of course not!

    People who are initially flagged as ineligible have sufficient time to correct the error, if, in fact, there is one. The final non-confirmation percent is a bit over 5% - about the same as the estimate of the percentage of our workforce made up of illegal aliens. Coincidence? You tell me…..

    For the last several years we have been hearing over and over how our “low” unemployment rate is an indication that we need all of these illegal workers. The unemployment rate has been artificially low for years because it only reflects a part of those workers who are unemployed or grossly under-employed. But even if you took the open borders crowd at its word, that old excuse is kaput.

    You do realize that undocumented workers using legitimate SS#s that don’t belong to them will skate under the E-Verify radar, right? Also, know this:

    • The SSA’s OIG found accuracy problems in the NUMIDENT file used to check employment eligibility status, estimating that about 17.8 million records have discrepancies with name, date of birth or death, or citizenship status. About 13 million of these incorrect records belong to U.S. citizens.

    • The Government Accountability Office has said that E-Verify still “is vulnerable to employer fraud that diminishes its effectiveness and misuse that adversely affects employees . . . such as limiting work assignments or pay while employees are undergoing the verification process.” These problems, although known since 2002, remain unresolved.

    • The U.S. Citizenship and Immigration Services commissioned an independent analysis of E-Verify that found that out of a sample of employees who received “final non-confirmation” notices, 42 percent were “false negatives” and were eligible to work. The analysis also found that “employers do not always follow federally mandated safeguards for the . . . program”, and that the employers took adverse action against an employee because of a “tentative non-confirmation,” even though it is illegal.

    • During an E-Verify pilot 30% of employers reported restricting work assignments while employees contest a tentative non-confirmation. Among the 67 employees who decided to contest a tentative non-confirmation, 45% reported one or more of the following adverse actions: were not allowed to continue working while they straightened out their records, had their pay cut, or had their job training delayed.

    •Current law also prohibits employers from pre-screening job applicants before making a hiring decision, yet some employers were doing just that. The SSA’s OIG found that 42% of employers used the program to prescreen employees, and 30% of employers used the program to verify the employment eligibility of their existing workforce. In 2002, the independent analysis found that, “[a]mong a sample of individuals classified on the transaction database as unresolved tentative non-confirmations, 28% said that they did not receive a job offer from the pilot employer.” Also, these job applicants were not informed they were being pre-screened through the employment eligibility verification system, and “[c]onsequently, they were denied not only jobs, but also the opportunity to resolve any inaccuracies in their Federal records.”

    Get the results of a study conducted last year, before you post outdated information about E-Verify.

    An independent study between April and June of 2008 by Westat found:
    • 96% of employees were verified instantly
    • 0.4% had to contact the government to resolve record errors
    • 3.5% received final non-confirmations, meaning they were illegal aliens not having the legal right to work

    I Bleed Obama Blue, The “inaccuracies” or discrepancies for eligible workers are usually a woman that has gotten married and has not changed her name for Social Security or a wrong middle initial. Both of these should be taken care of and are easy to accomplish.
    No data base is 100% accurate and you can make all of the excuses you want to. There is no valid reason why an employer should not use E-Verify, especially since it might protect them if they are caught with illegals in their employ.
    Also, there are always unscrupulous employers that exploit their workers and that is still no excuse not to use E-Verify.

    I called everyone on the list today. It only took a few minutes. Everyone was very polite and took my name and phone number. Interestingly enough, only Senator Saslaw’s aide asked where I lived. I guess he will disregard my call, since I don’t reside in the Springfield area. He should defintely be a target in the next election cycle, after what he did to keep any immigration reform legislation from leaving committee.

    The only point that “I Bleed Obama Blue” makes that actually has any validity is that a person using a valid SSN illegally could slide through. The solution? Simple: Send out those letters to employers that indicate that a SSN might be being used improperly and make it mandatory that they actually do something about it. There is a way to note that a SSN is being used by more than one person. No problem. The one soft spot of E-Verify is EASILY corrected.

    While we are at it, make it mandatory that letters be sent to ALL people using that SSN or better yet to the person who has been using that SSN consistenly for years. Wouldn’t you want to know that 15 illegal aliens were using your SSN if that was what was going on? I would. You could then present evidence that you were, in fact, the legal owner of said SSN and the rest could be taken care of.

    As for using the database to prescreen potential employees or to verify existing employees, what’s wrong with that? I’m all for it! If you are illegal, you are illegal. If you aren’t, you get cleared in seconds or you have ample time to indicate otherwise.

    Forget 2002 data, we’re talking 2007 or 2008.

    there is not perfect system. the system can have errors, yes.

    If E-Verify is implemented, in the case of a denied identity, the person should have a reasonable amount of time (60 days) to resolve the issue before the employer needs to deny them employment. This will clean up the system of errors.

    What to do - well, we are doing what we do best - stagnation, bickering and nothing. The usual, do nothing because it will impact the minority of people, instead of doing things that will possitivily impact the majority of people.

A friend of mine tried to hire 6 americans this week at $22 per hour. Only one showed up. Yea, these people really want to work. Please. You people are dillusional. Would you get up at 6 a.m and go pull weeds all day for $12 per hour? Sure you would! The $22 my buddy was offering was for average landscapers and he still can’t get people to go to work. Sick!     Let’s say illegal aliens make up 5% of the work force, as he suggests. In some industries, such as construction, that figure is tremendously higher. BLS is saying that the total employment in the US is about 142 million. That means there’s about seven million illegal aliens unlawfully working in the United States, which seems a little low, but let’s go with that for a while.

    If you have a job, this is just a meaningless statistic. If you’re a recent entrant into the labor force, this means a whole lot more. Unemployment among recent high school graduates is about 20%. In urban areas, that figure jumps well over 50%. Where’s your opportunity to gain experience and start climbing the ladder to prosperity when you have to compete with cheap illegal alien labor? Illegals depress prevailing wages, making it even harder since the few jobs you might be competitive for pay less, making it even harder to get ahead. If young African-Americans bear a disproportionate burden as a result of unlawful employment practices, are we just supposed to ignore it and accept this as the national price we pay of “only” 5% of the labor force being illegals?

    I seem to remember a time when liberals actually cared about the difficulties these folks faced.

    I hear pretty frequently from folks who didn’t get jobs because they couldn’t speak Spanish. An auto body mechanic in Manassas Park, a construction worker in Williamsburg, a bank teller in Manassas, a High School kid who wanted to bus tables in Haymarket. Because their employers had decided to avail themselves of the savings that accrue from unlawful hiring practices, these people face a much harder challenge getting a job. That 5% number means a lot to them, because they’re some of the ones paying the price.

    Right now the number of illegal aliens in Virginia is pretty close to the number of unemployed American citizens. If we actually bothered to enforce our laws, these unemployed Americans would have a much easier time finding work, because there would be jobs available. You want to call them lazy and shiftless, fine. I don’t see it that way. I see a lot of people frustrated that they can’t find work while illegal aliens are drawing paychecks. When the next election comes around, I’ll bet these American citizens are going to vote with me, rather than liberals such as yourself who clearly don’t give a hoot about them and even go so far as to insult them.

    Seven million. We could significantly address the national unemployment problem if we could just replace illegal aliens in the workforce with unemployed Americans, but you don’t even want to give them a chance to get a job and care not at all that the burdens fall disproportionately on minorities and youth. Call ‘em lazy. Go for it. Let’s see how that works out.

    Is this what Obama meant by “hope?” Permanent poverty and dependence for urban minorities for the benefit of illegal aliens?

    Oh I get the point. And before I head out for my first Bloody Mary on the Beach, let me tell you this. Newport News Shipbuiling (which hires only americans) has hired 1,230 people in the past year. Guess how many of the 1,230 were fired because of missing time or insubordination. Try 560. That is almost half of the people they hired. The majority of these people were African Americans. Is it just coincidence that 560 people didn’t want to work or is that just the luck of the draw? I was talking with a young man here in the Bahamas yesterday who moved here as well. He has two brothers who live in Indiana. Both were offered construction jobs at $14.00 per hour. Neither of them took the offer and instead are collecting unemployment. So, both sides of the story have merit. I know illegal immigrants are a problem in the states. But so are lazy americans. If you don’t believe that, then you are kidding yourself. There is always the solution of heading to St. Croix and having bloody mary’s at 10:00 a.m!

    Because 5% of the work force is made up of illegals, that is too many. Are you an American? If so, I guess you are the lazy type you talk about.

    Illegals are the problem from stealing jobs to raping children, to stealing the identities of others.

    Sure, there are some Americans who would rather suck off the system, we call them liberals. But for the vast majority of Americans it was hard work that made it possible for them to enjoy life and made America great.

    There was a story in the MJM a couple of years ago, that talked about a local company that hired immigrants. The company said it had problems hiring Americans at $8.00 an hour, but to immigrants from Mexico where the average pay was a dollar a day, $8.00 an hour seemed like a lot of money. Of course in this area it is impossible to support a family making $8.00 dollars an hour, the Company did not admit that, and the one immigrant who said he can send money home each month also did not mention his housing situation which most likely involved living in a house with many other people.

    Does that make Americans lazy for not taking a job they can neither live right or support a family?

    Did he also tell you about the sign on his desk? The one that says (I’m paraphrasing, since I can’t recall the exact wording) I will not make promises to support or not support a Bill, and that I reserve the right to change my mind up to the point of voting?

    Last year when I was in Richmond on lobby Day, I stopped by his office and while talking with him noticed the sign.

    Well Pete S. if you get fired or let go for cause you can’t collect unemployment in Virginia, so I don’t know about your 560 NNews employees that you talk about. How do I know this? Because it happened to me and I appealed and appealed and was refused unemployment money.
