Jeanette Rishell Loses Copyright Dispute

As I fully expected, the copyright infringement claim filed by Friends of Jeanette Rishell has been found meritless by YouTube this evening, and they have restored the videos Rishell’s campaign claimed violated their intellectual property.  So once again, we are able to provide the following to our readers, courtesy of YouTube:

Jeanette Rishell’s campaign claimed not that using short clips from their campaign videos violated their copyright, but that pointing out the picture of a used condom discarded in a toilet that campaign manager Ilana Kaplan-Shain had posted to her public facebook page infringed on the intellectual property of Friends of Jeanette Rishell.  To have a candidate complain on the basis of copyright law about videos critical of her candidacy is inane.  To have the campaign say that pictures of used condoms discarded in toilets are their intellectual property, which may not be used without permission, is fatally stupid.  Mind-boggling stupid.

At this point the only avenue open to Friends of Jeanette Rishell to prevent viewers from seeing this video would be if her campaign filed a lawsuit in a court of competent jurisdiction.  I sorely hope they do.  I can just imagine how the public would react to a candidate that started filing baseless copyright infringement lawsuits about pictures of used condoms.  A veritiable Circus Humongous would certainly result.

In the meantime, Jeanette Rishell still has not answered why she has Ilana Kaplan-Shain as her campaign manager.  While Rishell prattles on about protecting Virginia families, she not only hired a woman who has supported putting hard-core pornography in schools, written approvingly of casual homosexual sexual encounters, and glorified encountering used condoms in hotel rooms — while she was acting as Rishell’s campaign manager.  After the sordid behavior of this employee was brought to light, she actually kept her in charge of her campaign.  Since actions speak one heck of a lot louder than campaign rhetoric, it’s beyond clear that Rishell’s means of protecting Virginia families is vastly at odds with what the voters in this District believe.

Jeanette Rishell is either the dumbest candidate in history, or the worst candidate liar we’ve ever seen in politics.  It’s really hard to tell which.

UPDATE: Not Larry Sabato picks up on this as well, saying:

“What’s even worse, and worthy of public ridicule is that Ilana Kaplan-Shain had the pictures on her own facebook account- so instead of challenging the video to Youtube as violating HER intellectual property- she did so as “Friends of Jeannette Rishell”, claiming the used condoms were the campaign’s intellectual property instead of her own! ”

This girl needs to find a new career- she isn’t smart enough for politics.

    Of note, as of this evening the various sites where this video has been posted have registered 1,480 views and the video discussing Rishell’s baseless copyright infringement claim has been viewed 410 times.

    I can’t imagine Rishell can hide from this much longer…

    Where is the press on this? Are they actively trying to protect this loony liberal by ignoring stories like this? If a Republican had done this, it would be on CNN, ABC, NBC and CBS every night for a week.

    This is turning out to be a popular video now that YouTube has let people see it again. Between all the sites where it’s available, the videos of “Jeanette Rishell and Used Condom Girl” has been viewed 1,829 times and the video about Rishell’s copyright infringement claim has been seen 420 times, for a grand total of 2,249 views. And it’s still August.

    The last time Rishell was on the ballot, 10,281 votes were cast, of which 4,033 were for her. Within two weeks, a number of people exceeding 20% of the voting electorate have been informed about Rishell’s incomprehensible lack of judgment.

    By the time the election rolls around, it’s quite possible that half of the people going into the polls will have seen a video about Rishell and her campaign manager.

    Where the heck is the mainstream media on this, or do they just think it is OK for candidates to hire porn advocates on their campaign staff? If a Republican did something like this, it would be all over the news. Here you have a candidate who hires someone with a huge amount of bad history, and there’s nothign but silence about it.

    Isn’t the supposed job of the media to actually do journalism, find out the facts, and report them? In this case they never bothered to look at a thing, when someone else came up with the truth they ignored it, and now that Rishell has been trying to supress the truth with bogus copyright claims for weeks they still have their heads in the sand.

    WTF??? WHERE THE HECK ARE THE JOURNALISTS?

    Are only Republicans given any kind of scrutiny?

    Why would a hot shot “Political Consultant” (code for unemployed?) like Rishell need a campaign manager?

    In the case of Rishell and Kaplan-Shain, it seems to be a case of the blind leading the blind.
