Bob McDonnell Announces Support For State-Wide 287(g) Program

In case anyone out there was still wondering whether Bob McDonnell wanted to help reduce the number of illegal aliens unlawfully residing in the Commonwealth, the DC Examiner reports today that McDonnell has gone on record supporting the participation of the Virginia State Police in the Section 287(g) Program.  While Governor Kaine has steadfastly refused to get state officials involved in any immigration programs during his tenure, and done absolutely nothing about this serious problem, Bob McDonnell clearly intends to do better.  That’s welcome, and wholly expected news.

The Republican said he would like to see Virginia State Police trained for the program, known as 287(g), which allows local law enforcement officials to enforce some federal immigration laws. Some local jurisdictions in the state, including Prince William and Loudoun counties, participate in the program.

“I have urged Governor Kaine for one and a half years to enter into [the] partnership,” he said in an interview with reporters and editors at The Washington Examiner. “It would be a proper and limited tool to help us enforce the law.”

Getting the VSP engaged in this program requires nothing more than an executive order, and the program as it currently exists has proven to be a very effective tool in getting criminal aliens deported.  Prince William County enrolled in Section 287(g) in 2007 and instead of removing perhaps a hundred illegal aliens a year without the program, has turned over more than 1,600 criminal aliens to federal immigration authorities. 

The program trains officers and jail officials to identify illegal aliens, provides then with special access to computer systems run by the Bureau of Immigration and Customs Enforcement, and authorizes these trained officers to process deportation detainers on any illegal alien they encounter.  Illegal aliens are then turned over to ICE for deportation after they have served any sentence imposed, instead of releasing them back into our communities.  We saw in 2007 that several hundred illegal aliens were on the Virginia Sex Offender Registry and had been released, a typical result of the procedures that govern jails without the program, until Bob McDonnell started a special initiative with ICE that rounded up these dangerous illegal aliens and got them deported.

One development that potentially undercuts this program is the Obama Administration’s imposition of a new “one size fits all” program on participating law enforcement agencies.  The administration wants to reduce the number of illegal aliens deported who commit lesser felonies and misdemeanors, many of whom later graduate into serious felons that commit much more serious crimes, as we’ve seen in the past.  Even with the Obama administration’s intent to reduce the effectiveness of this program, it will still remain a useful and important tool to help address the non-enforcement of our nation’s immigration laws that encourages illegal immigration.

Hopefully in the coming weeks Bob McDonnell will have the opportunity to address E-Verify, which he also supports, and would help prevent illegal aliens from being hired by the Commonwealth, it’s contractors, and businesses in Virginia.

Not only has he done nothing about it, he’s actively supported the influx of illegal invaders. One of his self-professed goals was to, “Internationalize Virginia.” If he took a bike ride down our Route One corridor he’d see the results of his “Internationalization.”

    Creigh Deeds will only perpetuate this love affair that this state’s Democrats have with illegal, low-cost, slave labor, mainly from Latin America. When I personally asked Deeds to support a state-wide 287-g bill, he asked me, “Who is going to work at the Wall Mart’s and McDonald’s if we do that?” That was when unemployment of 18-25 y/o Virginians was at 15%. Now it’s closer to 30%. He would rather import slave labor than see your kids get jobs.

    If you or someone you know is out of a job, you can blame the Kaine-Deeds open borders philosophy.

    Finding out about E-Verification, 287 G local police arrest , No-Match-Letters, 1986 Simpson/Mazzoli bill, and other immigration enforcement laws, the reader should GOOGLE–NUMBERSUSA and JUDICIAL WATCH? Here you will find the absolute truth and not the meandering propaganda addressed by the special interest lobbyists or the deceiving national press. We can burying the head in the proverbial sand, or do something to save your quality of life in our nation. E-Verify from the beginning has been demonized, and only bloggers like me brought its operation to gain national attention? IT WORKS! So without public outcry, the bill would have ended up in a dusty draw of the Senate. Now–these same people are out to crush 287 G, because it also works. Yet right now the usual suspects are requesting the Federal court delay the full implementation of E-verify for government contractors. I’m sure that pro-illegal immigrant lawmakers such as Sen Harry Reid, House Speaker Nancy Pelosi, Homeland Security chief Napolitano and many more, will try to use their influence on behalf of greedy businesses who demand cheap wage workers to join their slavery forces.

    After federal training local police have the authority to check a persons identity and detain them for ICE. President Obama is currently being pressured to rescind the no-match-letter. A immigration tool that notifies employers of discrepancies in a persons identity, for a right to be employed. Sen. Edward Kennedy was a major sponsor of the 1986 (IRCA) immigration act, that strengthened importation, allowing cheap labor into our country, including the fact he promised–NO MORE AMNESTIES.

    America has no chance of passing a worthwhile public option for health care, because we will also be paying for illegal aliens along with their families. The bill has no restriction in the wording to authenticate a persons legal status. Personally, I want a single payer system to stop the profiteering by insurance companies, but I don’t want to be taxed for underwriting illegal immigrants and their families? Even if they add an amendment declining illegal immigrants from the health care bill, they will still be included if the Democrats enact another path to citizenship? Then what about the others on the opposite side of our weak fence, they will hear the Amnesty bell chiming and rush for the border, or enter as tourists in an airport. I repeat we cannot even look after our own impoverished and homeless, even many veterans live under bridges. Pandering to foreign nationals legislators have ignored our aging infrastructure, our bridges, roads and tunnels.

    I’d expect Deeds to now come out with his own statement supporting the 287 program, since he copies Bob on all of the major issues, and is not able to come up with any ideas until after Bob does.

    E-Verify for federal contractors is supposed to start on September 8th. I haven’t heard ANYTHING about it. I guess we’ll have to see what happens on Tuesday. And if Bob is elected as Governor we will be pushing him to implement the same in Virginia.

    Please consider:
    - A state-wide 287(g) may not be in our local best interest
    because it will spread the finite resources of ICE over a much
    larger area. Our ability in PWC and Manassas to claim ICE
    detention slots will be hurt. It is hard to believe that
    ICE capacity in Virginia will have a dramatic increase under the
    present administration in Washington.
    - Some business owners (mostly Republican) have a share of the
    blame for the immigration mess because of a love for low
    wage workers willing to do dirty jobs and keep quiet about safety
    and sanitation. The next Gov. will have to be as firm and
    direct with them as he must be with the looney left and
    Democrats pandering for Hispanic votes.
    - We are now in the crazy season of campaigning and
    charges and counter-charges are going to be flying by at a
    rapid rate by and about everyone running. Don’t believe
    everything you read or hear without solid confirmation.

    Most jails in the Commonwealth have already signed a 287(g) agreement with ICE, or partnering with regional jails that do.

    All 287(g) does is remove CRIMINAL illegal aliens who have been convicted of a felony.

    287(g) does NOTHING about the rest of the illegal aliens who fly under the radar or commit misdemeanors. Look to PWC - how many illegal aliens did ICE accept?

    McDonnell is playing you - he’s telling you what you want to hear. And you’re buying it!

    Try to pin him down about E-Verify as a state mandate, and he will come up with a hundred excuses to justify why he can’t do it. Trust me, we ‘ve asked him and the answers from his camp range for absurd to inane.

    E-Verify for government contracts has no effect on all the thousands of other businesses in the Commonwealth. Without E-Verify as a state mandate, don’t expect to see a reduction of illegal aliens.

    Actually Junes, you are incorrect in many respects here.

    Although the General Assembly passed a measure recently that required all local jails to check for immigration status at intake, only Herndon, Prince William County, Manassas, Manassas Park, Shenandoah County and I believe Rockingham County have 287(g) agreements. Out of 109 localities in Virginia, that’s a pretty small piece.

    Currently each locality comes up with their own Memorandum of Understanding with ICE, and these agreements currently list the crimes under which a 287(g) investigation is triggered. In Herndon that list includes a number of misdemeanors including drunk driving. In Prince William County that list specifies a number of misdemeanors as well, and concludes with “all other crimes against persons or property”.

    ICE accepted ALL individuals processed for deportation by the Prince William County Adult Detention Center, pursuant to the MOU. Since all detainers are processed under the supervision of an ICE agent and with their authority, ICE is bound to take every individual with a detainer. What happens after ICE takes custody of an individual with a detainer is up to ICE, and we don’t know what precisely happened to these individuals, but Prince William County has turned over more than 1,600 persons so far.

    Much of this may change after DHS’s “one size fits all” policy goes into effect, but at least that’s how it has been working up to now.

    Sadly, Junes may have it right. There is a big component of Republican businesses — the Chamber of Commerce crowd — who like to have illegal immigrants around to keep wages down. We all need to push for E-Verify and BIG $$$ penalties for business owners who hire illegals. I hate to say it, but the Obamma administration is way ahead of his predecessor on this one…. maybe because they didn’t get any campaign donations from this crowd.

    I’m tending toward McDonnell but am wondering how he got so many chambers of commerce to endorse him. I know its supposed to be because of no new taxes, but I thought they loved illegal immigrants and knowing McDonnell’s stance on illegals, this doesn’t make sense to me.
