Four Years Later, Fernandez Finally Being Held To Account

The News & Messenger is reporting a surprising set of developments surrounding the ongoing civic vandalism of Mexica Movement adherent Gaudencio Fernandez today, revealing that Fernandez will actually face prosecution for erecting huge signs on his property in violation of Manassas City building and zoning codes and that Fernandez is claiming to have sold the property at the corner of Prince William and Liberty Streets. After having given Fernandez an unprecedented amount of deference when faced with his continual flouting of the law, it finally is going to do something about this miscreant and his unlawful behavior. It has only taken four years to begin to prosecute this man, when you or I would have been slapped down immediately for doing much less.
Fernandez has played a game of erecting enormous signs in the historic district filled with his usually incoherent and racially-charged rantings, then waiting for the city to react. After weeks or months, the city would finally get around to giving him a notice of violation, schedule a court date for enforcement, and then on the day before the court date Fernandez would take down whatever sign he had put up. The city would breathe a sigh of relief and stop all enforcement actions, and then in a few more months Fernandez would start this game all over again. The last time we played this kabuki dance, the city said really this time, really we mean it when we say “don’t do this again.”
Well, Fernandez has, unsurprisingly. What is a surprise is that now the city is actually going to prosecute Fernandez for the last violations against which prosecution was halted after that sign was dismantled. Hopefully they’ll tack on prosecution of all previous violations as well into a big civil fine that would end up being placed as a lien on the property and then force the sale of the property. Fernandez must understand that he’s actually in some trouble at this point because he’s making claims that the property has been sold, although no transfer of deed has been recorded. If Fernandez still holds this property when a judgment against him is handed down, Fernandez will likely lose this property unless he’s willing to pay a pretty substantial fine.
Or perhaps Fernandez doesn’t actually understand and is trying to simply evade prosecution. I’ve seen his letters back and forth with the property code enforcement people and his laughable zoning application for the hundred foot sign he wants to erect, and his understanding of the law is about what you’d expect to see from a second grade child if that child was steeped in neo-Marxist class warfare dogma. He hasn’t a clue what he’s doing, demands the city provide him with free legal advice to help him advance his cause, and makes bizarre and rather impolitely worded claims of mistreatment. Not even the city’s deep reluctance to hold any minority activist accountable to the law will prevent Fernandez from bumbling himself right into the worst position possible through his bitterly determined utter incompetence.
That’s our saving grace here. Fernandez is his own worst enemy. If the city stands firm and doesn’t try to rescue Fernandez from the legal landmine he’s stepped on here, we could be rid of this bothersome nuisance soon.

The little voices in my head are telling me I should offer to represent him.
If he is found guilty it will be nothing more than a slap on the wrist for a zoning violation. He is not going to lose the property if convicted and it hasn’t been sold.

Sounds like another civil liberties, constitutional rights, free speech suit against the City of Manassas. I’m not saying what is right or wrong. I’m just saying that from a liability perspective, the City should drop this quickly. But then, I don’t pay taxes there so it will be fun to watch (as long as Manassas doesn’t ask for a County bail-out some day).
Despite the chagrin of some, I trust the City of Manassas will

and crossing every “t”. It must not allow Mr. Fernandez are
others to goad it into a rash action.

This is not about free speech. This is about a guy who has broken the law, provided a second chance, and wasted it.
Just saying,
It’s not a civil liberty case, it’s a zoning case.
But, is he an illegal? Does not matter if he is or is not, he represents and supports the illegals and illegals have far more rights than Citizens.
That’s just the way it is ………..
Citizen of Manassas, The courts will decide what it is legally… and it will be expensive for the good people of Manassas… but fun to watch.
Simplifying this complex legal issue will probably be the reason for the lawsuits that are sure to follow.

You know the old saying……sometimes it isn’t about the money? That SOB has been playing games with the City for years now, at least 4. He needs to be accountable for breaking the zoning laws.

In my opinion this has nothing to do with civil liberties, the U.S. Constitution in not in play here and this man has negated any protection provided by the Virginia Constitution by the violation of established law.
Per Article 1 section 12 …..”that any citizen may freely speak, write, and publish his sentiments on all subjects, being responsible for the abuse of that right”
He must be held “responsible for the abuse of that right” as to the manner in which he chose to exercise this right.
