Illegal Alien Charged With Rape of 11 Year Old

By Greg L | 19 February 2010 | Illegal Aliens, Crime, Prince William County | 32 Comments

Perhaps you were wondering whether Jose Piedad Don Juan Martinez might be an illegal alien.  Martinez was recently charged with two counts of rape and one count of attempted rape involving an eleven year old girl, an utterly shocking crime that in the past has been almost uniquely committed by those whose entire existence in the United States is characterized by flaunting the law.  I contacted the Prince William County Police Department with this question, and indeed, the answer to this question was affirmative.

So why does a crime like this immediately raise in people’s minds questions about legal status?  No, the name of the suspect isn’t a tipoff, although there are those determined to claim that anyone wondering about this connection between illegal aliens and sex crimes against children is inherently racist.  That’s a thin and disingenuous cover designed to prevent discussion of a real and troubling facet of the illegal immigration problem.  The issue here is that those who flagrantly violate our laws and demonstrate utter contempt for the rule of law are precisely those who would display contempt for the interests of the vulnerable.  They’re the “takers.”  The mentality of those who disregard our laws is that they’re entitled to take whatever they can get, and if the innocence and future of a child stands in the way of them taking what they want, they cross that line just as surely as they illegally crossed our borders.

An illegal alien also isn’t someone dedicated to embracing American culture because they’re making a commitment to a new life and a new identity as an American.  They’re going to carry along all the cultural detritus of their home country along with them instead, and that means carrying along some of the utterly reprehensible perversions of some other countries.  Some of these cultures actually condone the abduction and rape of children like this, with only a token payment made to the family of the victim as repentance.  Before the influx of illegal aliens into our community, crimes such as this were virtually unheard of.  Now that we have a large illegal alien community, these crimes are sadly a regular occurrence.

Whoever unlawfully employed Jose Piedad Don Juan Martinez shares responsibility for this tragedy.  Whether it be the idiots who picked him up as a day laborer and facilitated his unlawful presence, or S&N Communications, that could have hired him as one of the laborers doing FIOS installations in the county, or if it was McDonalds paying this human predator to flip burgers during the day so at night he could sexually assault an eleven year old child, whoever it was bears some degree of responsibility for this crime.   Jose Piedad Don Juan Martinez was here because someone made it possible for him to work here.  They also made it possible for him to rape children here.

This vermin (yeah, libs, go ahead and complain as usual that I’m calling an illegal alien child sexual predator “vermin,” because that’s precisely what he is) will be held on an immigration detainer and after he completes whatever sentence is handed down to him, he will be turned over to ICE.  Let’s hope the Obama Administration is no longer what that happens, otherwise it’s very likely they’ll have ended the Section 287(g) Program that deports vermin like these instead of releasing them back into our communities.

The employers of illegal aliens facilitate horrific crimes like this.  Federal, state and local governments that refuse to enforce our nation’s immigration laws facilitate crimes like this.  Had government, at any level, got and kept illegal aliens out of the United States as they’re supposed to, Jose Piedad Don Juan Martinez would not have been here to rape an eleven year old child multiple times.

Apparently he was living in the same house and was a relative of the victim. That also sets off a red flag.

Greg, I agree with your post. However, if you are attempting to shame the criminals who employed this POS, or other like him, you are wasting your time.

Like the democratic party, like their media enablers - shame left these folks long, long ago.

It’s bad enough he raped an 11 yo but to do that to a relative? What sort of animalistic culture condones this behavior where a member can basically choose between a relative and an outsider? Is it about convenience? Or no consequences from the other relatives? I doubt it’s just the rapist that is the sick bastard here.

“Vermin” is too mild of a word.

Need to find out where the scumbucket worked and start writing letters to the editor of all the local rags and letting our Federal elected officials know so that if they chose to, they can force ICE to do something to these employers. This illegal alien needs to be neutered, don’t care if it’s chemically or with a dull knife. Messing around with an 11 year old is sick and twisted.

the interesting thing is that inside nova wont post status of illegal aliens in their paper anymore…it’s easily confirmed if they are/are not if they have been arrested for a crime. this should be information that is posted in the papers, so people can REALLY see how big the problem is.

Chicko, your right about the local rag not posting the status anymore - same as the stopped posting the results of Grand Juries. If you go up on the Court website and look down through the cases, there is at least a half-dozen of these types of rape…and the “defense” it is just cultural.

And yet our local rag complains they are losing money. If they would report like they used to, maybe they wouldn’t.

I’ve heard about things like this. Draw a conclusion about an entire group of people based on the actions of one. There really are people in the world ignorant enough to do that. Wow

This isn’t an isolated example. When the same thing happens over and over, the intelligent response is to look for a common factor so as to determine the cause of the problem.

    You got that right …said!

Like how many “actions of one” do we need before it becomes valid to draw a conclusion?

Greg said “Before the influx of illegal aliens into our community, crimes such as this were virtually unheard of.”

That is absolutely a false statement. I have worked in the public sector for many years and have worked closely with law enforcement, both adult and juvenile. This happens more than one would suspect but most of the stories do not reach the media.

It is an abhorrent crime but do not judge a whole group of people by the actions of a few.

What Greg said is factually and demonstrably true.

Before the illegal invasion, illegals raping children was virtually unheard of.

AnonII, are you trying to imply that child rape has only been reported in the local press when the perpetrator is hispanic? Or when the perpetrator is an illegal alien, although the paper doesn’t identify the suspects as such these days?

In the past several years I recall at least four of these incidents involving children as young as nine years old, and every one involved an illegal alien. I would seriously doubt there are additional cases involving other persons that the News & Messenger decided not to report on, or the police decided not to inform the public about.

Check the BVBL archives, and you’ll find them.

Where’s nova on this? Isn’t it possible the perp was actually an Estonian with an hispanic alias designed to throw off those pesky Latvians? Conservative…tee, hee, hee!

A person (including a group of persons, business, organization or local government) commits a federal felony when he:

    * assists an alien whom he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him to obtain employment,
    * encourages that alien to remain in the U.S., by referring him to an employer, by acting as employer or agent for an employer in any way, or
    * knowingly assists illegal aliens due to personal convictions.

Penalties upon conviction include criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime.

Correct me if I am wrong, but since it is a felony, we can make a citizen’s arrest?

I can think of at least two child sexual assaults/rapes within a mile and a half from me - a 1 1/2 year old baby girl (Lomond Drive) and a 9 year old girl (down in the Amherst Drive area). Both were committed by illegal aliens living in illegal alien boarding houses. Last year the local paper was chock full of rape and sexual assaults. It was like an epidemic. Only a few of the perpetrators were American. However, all of the perpetrators are the lowest form of pond scum.

Don’t forget about the sexual assault of a 11 year old near Colton Lane.

You can bet EB and AP will not do a documentary about these rapes.

Can anyone answer my question from a legal standpoint? If a person is knowingly employing illegals, or harboring them in any way it is a felony. Can we arrest that person on a citizens arrest since it is a federal felony?

I’m not a lawyer, but I understand that in Virginia a person may perform a citizen’s arrest for a “breach of the peace” or a felony that is committed in your presence. You’re required to turn over arrestees to law enforcement, and there may be a limit (perhaps an hour) on the time you can detain someone until you turn them over to the police.

If you do this, you are subject to all the legal liabilities and procedural requirements that police face, only you don’t have the shield of the state like they do. False imprisonment is a felony itself, so if you get it wrong, you’re the one going to jail.

Tread very cautiously in these waters. They’re fraught with peril.

ditto what Greg said…dont go there,

you gotta be totally right, the police get the right to catch and release…you dont.

unless you are 200 percent sure, i.e. you see someone shooting someone (with a real gun) and running away and shooting other people or something crazy like that I wouldnt even think of jumping into the fray..havent heard of it being used much, it’s just too freakin’ dangerous these days to do it.

Wouldn’t the most BASIC prerequisite to making a “citizen’s arrest” be, BEING a CITIZEN ???

Yes, I agree they are fraught with peril. However, those who employ illegals do so openly. They almost make it easy…

those stories about illegals suing are pretty blood boiling, seems to be happening alot. I think mostly in CA, AZ and those places where they congregate the most. I hear alot of them are coming forth in AZ because of Sheriff Joe (who is my hero by the way for doing the right thing and rounding up vermin illegals)

until the Government actually starts supporting bagging and tagging these invaders we’ll see more of these lawsuits.

Looks like a couple of more illegals kidnapped an 11 year old girl from a park and raped her at their apartment in Maryland. The girl was able to lead police back to their place.

From the Washington Examiner - “Suspected illegal alien gang members arrested for rape of 11-year-old girl”

Maryland and Montgomery County Sanctuary policies in action.

But, as the listing of crimes committed by the illegals indicates, this is only an isolated case! Probably want happen again until sometime later tonight or tomorrow!
